CHAPTER 17

24.- R-G GENERAL RESIDENTIAL DISTRICT

Sec. 17.24.010.- Established; purpose.

The R-G General Residential District is established in which the use of the land is restricted as provided in this chapter. The intent of this chapter is to:

A.

Acknowledge and allow the continuance of existing residential uses;

B.

Acknowledge the need for and provide for municipal services to such property without encouraging any increase in the intensity of use of the land and the district;

C.

Encourage the development and continued use of the existing and/or surrounding residential uses without inducing undue hazards to public health and safety;

D.

To prohibit industrial and commercial uses and to prohibit uses which would substantially interfere with the residential use.

Sec. 17.24.020. - Permitted uses.

Permitted uses in the R-G General Residential District are as follows:

A.

One-family dwellings which may be of modular home construction;

B.

Two-family dwellings which may be of modular home construction;

C.

Multiple-family dwellings;

D.

Churches and church facilities;

E.

Colleges and universities;

F.

Boardinghouses and roominghouses;

G.

Fraternity and sorority houses;

H.

Hospitals;

I.

Nursing homes and sanitariums;

J.

Medical, dental and optometry clinics;

K.

Swimming pools and nonprofit, quasi-public recreational uses;

L.

Accessory structures and accessory uses.

Sec. 17.24.030. - Minimum lot requirements.

Minimum lot requirements in the R-G General Residential District, except as otherwise provided for in this chapter, are as follows:

A.

Six thousand square feet for one dwelling;

B.

Six thousand square feet for two-family dwellings which are owned by a single individual or entity;

C.

Twelve thousand square feet for two-family dwellings which are developed and built for separate ownership of each individual dwelling unit;

D.

Nine thousand square feet for multifamily dwellings;

E.

Two thousand square feet for townhouses when clustered as three or more units;

F.

Six-thousand square feet for medical, dental and optometry clinics;

G.

Twelve thousand square feet for all other listed uses.

Sec. 17.24.040. - Affordable small lot exception to minimum lot requirements.

For the purpose and intention of encouraging construction of affordable one-family dwellings, two lots may be created by the division of a vacant existing corner or reverse corner lot which are smaller than the minimum lot requirements identified in section 17.24.030, so long as the following conditions are met:

A.

The corner or reverse corner lot to be divided is located within the original townsite of Powell and within the R-G General Residential District and is a vacant lot.

B.

The use of each lot created under this exception is restricted to one-family dwellings.

C.

Each created lot is two times the total floor area of the one-family dwelling, but not less than 3,500 square feet.

D.

Each created lot must have at least one public street line.

E.

Each created lot must comply with all setbacks and proportion, height and density requirements in this chapter.

Sec. 17.24.050. - Minimum width of lot at front setback.

Minimum width of lot at front setback in the R-G General Residential District is as follows:

A.

Fifty feet for a one-family or two-family dwelling;

B.

Seventy-five feet for a multifamily dwelling;

C.

Eighteen feet for a unit which is a part of a cluster of townhouses and defined as a townhouse;

D.

One hundred feet for all other listed uses except medical and dental clinics, for which the minimum requirement is 50 feet.

Sec. 17.24.060. - Minimum proportion.

In the R-G General Residential District, the minimum proportion of lot in unobstructed open space is 25 percent.

Sec. 17.24.070. - Minimum setbacks.

Minimum setbacks in the R-G General Residential District are as follows:

A.

Street right-of-way: 15 feet;

B.

Alley right-of-way: 15 feet;

C.

Adjacent lot line: one foot for each three feet or fraction thereof of the nearest wall height to the setback line, except that no adjacent lot line setback shall be less than five feet for any residential use, nor less than 15 for other uses listed.

Sec. 17.24.080. - Maximum height—Primary structure.

Maximum height of primary structure: Wall height shall not exceed 30 feet and the structure shall not exceed two stories.

Sec. 17.24.090. - Same—Accessory structure.

Maximum height of accessory structures: not to exceed the height of the primary structure.

Sec. 17.24.100. - Two-family dwellings.

Two-family dwellings shall be located in R-G or I-L zone districts and in accordance with the following requirements which are intended to be supplementary to and exclusive of other zoning and subdivision regulations of the city:

A.

All two-family dwellings which are developed and built for separate ownership of each individual dwelling unit shall be subject to review by the development review committee;

B.

There shall be allowed a zero lot line setback on any common wall of any two-family dwelling.

Sec. 17.24.110. - Multifamily dwellings.

Row housing, condominiums, townhouses, and other such multiple-family dwellings shall be located in R-G zone districts and in accordance with the following requirements which are intended to be supplementary to and exclusive of other zoning and subdivision regulations of the city:

A.

All multiple-family uses shall be subject to review by the development review committee.

B.

Each such structure shall have yard clearances from structure to the lot lines not to be any distance less than those specified for other residential uses in residential general zones. In addition to the space required for such clearances, each such structure shall have a minimum of 150 square feet of unobstructed open yard space per each dwelling unit, at least 100 square feet of which per unit shall be landscaped and located in the front setback of the property. All proposed landscape designs shall be first submitted to and approved by the city parks superintendent.

C.

The distance between the main buildings and accessory buildings shall not be less than ten feet.

D.

Where a roadway is provided in a court, place, or side yard for off-street access, the width for such roadway shall be in addition to other space requirements of this chapter and in no case less than 20 feet in width.

E.

All roadways and parking spaces shall be of a dust-free nature, surfaced with either concrete or asphalt type substance clearly marked and identified.

F.

Garbage containers shall be placed on the alley side of units on concrete pads as determined by the development review committee.

Sec. 17.24.120. - Density.

The ratio of dwelling units to land area. Density in row housing, condominiums, townhouses and other such multiple-family dwellings is limited to 16.5 dwelling units per acre of land; the density of all other residential uses is limited to eight dwelling units per acre of land.
