The B-G General Business District is established in which the use of land is restricted as provided herein. The uses permitted within this district are those that will provide the maximum amount of service to the general public without creating an adverse impact or undue traffic hazards and congestion. The intent of this chapter is to:

A.

Encourage the development of and the continued use of the land for retail, service, public and private office, and associated businesses and commercial uses that can be aggregated at heavy commercial density without inducing undue hazards to the public health or safety;

B.

Encourage the development and continued uses of multiple uses within one structure without inducing undue hazards to public health or safety and with construction of the structure in accordance with law;

C.

Provide for the orderly expansion and redevelopment of such uses within the general business districts;

D.

To prohibit heavy commercial use of the land and to prohibit uses which would substantially interfere with the continuation of the uses presently in general business districts that would be permitted as new uses or with the orderly growth of the district to meet the need of increased population in the market area;

E.

To encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this chapter;

F.

To permit a concentrated intensive development of the permitted uses while maintaining an adequate relationship between the intensity of land uses and the capacity of supporting utilities, transportation networks, and open space.

Permitted uses in the B-G General Business District shall include, but not necessarily be limited to:

A.

Retail sales and service of all types;

B.

Personal service shops;

C.

Hotel, motel, and convention centers;

D.

Offices, professional offices, and medical services;

E.

Restaurants;

F.

Financial institutions;

G.

Governmental offices, services and facilities;

H.

Churches;

I.

Private, nonprofit clubs and lodges;

J.

Hospitals and clinics;

K.

Recreational and amusement facilities;

L.

Libraries;

M.

Museums;

N.

Small animal hospitals or clinics;

O.

Automobile or vehicle sales except in areas allowing permitted residential uses as set forth in section 17.36.030(A);

P.

Motor vehicle service stations except in areas allowing permitted residential uses as set forth in section 17.36.030(A).

Provided that subsections K and N of this section shall be completely enclosed, recapping of tires shall not be permitted under any circumstances, cleaning shops shall be limited to those involving perchoroethylene package methods for collection and distribution only.

In addition to the permitted uses set forth in section 17.36.020, there shall also be allowed limited residential uses in the B-G General Business District as follows:

A.

Subject to the limitations and restrictions set forth in this chapter, residential uses shall be allowed within the confines of the following general business district: the west one-half of block 43; blocks 44, 45, 46 and 47; the west one-half block of 48; blocks 54 and 55; the west one-half block of 56; the east one-half of blocks 111, 118, 119 and 126.

B.

Residential uses shall be allowed within the second floor of any two-story building, and shall be allowed on the first floor subject to the following conditions being met: Any residential use in the first floor of any building shall be restricted to the rear one-half of any building or structure and any such residential use shall occupy less than 50 percent of the floor area, shall be primarily accessed from the rear and/or side of the building or structure and is limited to owner or operator occupation and residential use only.

The maximum height in the B-G General Business District is as prescribed by the adopted International Building Code.

The maximum floor to lot area ratio in the B-G General Business District is 2:1.

Permitted location of structures in the B-G General Business District is anywhere on the lot so long as adequate ingress and egress is provided and a clear vision triangle is maintained within 25 feet of the intersection of two streets of a railroad right-of-way and a street, or of a driveway and a street.
