CHAPTER 17

32.- R-M RESIDENTIAL MIXED USE DISTRICT

Sec. 17.32.010.- Defined.

The R-M Residential Mixed Use District is a residential district with restricted commercial uses which can be combined with residential uses.

Sec. 17.32.020. - Permitted uses.

A.

Generally. Permitted uses in the R-M Residential Mixed Use District are as follows:

1.

One-family dwellings;

2.

One apartment per building as part of commercial use;

3.

Two-family dwellings;

4.

Multifamily dwellings:

5.

Mobile homes;

6.

Limited commercial uses;

7.

Accessory structures and accessory uses.

B.

Commercial uses.

1.

Permitted commercial uses shall include, but not be limited to, the following:

a.

Plumbing, electrical, roofing, carpenter shops and enclosed storage;

b.

Auto repair shops;

c.

Gas stations;

d.

Frozen food lockers;

e.

Recreational uses;

f.

Veterinary hospitals;

g.

Convenience stores;

h.

RV parks;

i.

Professional daycares; and

j.

Churches.

2.

The site design of any commercial use facility shall be constructed and designed to minimize the migration of dust, odors, refuse, noise, lights and vibrations off site; and

3.

Outdoor storage areas shall be concealed from view from abutting streets and highways, and from adjoining residential.

Sec. 17.32.030. - Minimum area.

The minimum area in the R-M Residential Mixed Use District is as follows:

A.

Six thousand square feet for one dwelling;

B.

Six thousand square feet for two-family dwellings which are owned by a single individual or entity;

C.

Twelve thousand square feet for two-family dwellings which are developed and built for separate ownership of each individual dwelling unit;

D.

Nine thousand square feet for multifamily dwellings;

E.

Two thousand square feet per townhouse when clustered as three or more units.

Sec. 17.32.035. - Affordable small lot exception to minimum lot requirements.

For the purpose and intention of encouraging construction of affordable one-family dwellings, two lots may be created by the division of a vacant existing corner or reverse corner lot which are smaller than the minimum lot requirements identified in section 17.32.030 so long as the following conditions are met:

A.

The corner or reverse corner lot to be divided is located within the Original Townsite of Powell and within the R-M Residential Mixed Use District and is a vacant lot.

B.

The use of each lot created under this exception is restricted to one-family dwellings.

C.

Each created lot is two times the total floor area of the one-family dwelling, but not less than 3,500 square feet.

D.

Each created lot must have at least one public street line; and

E.

Each created lot must comply with all setbacks and proportion, height and density requirements in this chapter.

Sec. 17.32.040. - Minimum width.

The minimum width of lots in the R-M Residential Mixed Use District is 50 feet.

Sec. 17.32.050. - Minimum setbacks.

Minimum setbacks in the R-M Residential Mixed Use District are as follows:

A.

Street right-of-way: 15 feet;

B.

Alley right-of-way: 15 feet;

C.

Adjacent lot line: one foot for each three feet or fraction thereof of the nearest wall height to the setback line, except that no adjacent lot line setback shall be less than five feet for any residential use, nor less than 15 for other uses listed.

Sec. 17.32.060. - Two-family dwellings.

Two-family dwellings may be located in R-M zone districts and in accordance with the following requirements which are intended to be supplementary to and exclusive of other zoning and subdivision regulations of the city:

A.

All two-family dwellings which are developed and built for separate ownership of each individual dwelling unit shall be subject to review by the development review committee.

B.

There shall be allowed a zero lot line setback on any common wall of any two-family dwelling.

Sec. 17.32.070. - Multifamily dwellings.

Row housing, condominiums, townhouses, and other such multiple-family dwellings may be located in R-M zone districts and in accordance with the following requirements which are intended to be supplementary to and exclusive of other zoning and subdivision regulations of the city;

A.

All multiple-family uses shall be subject to review by the development review committee.

B.

Such structure shall have a minimum of 150 square feet of unobstructed open yard per each dwelling unit, at least 100 square feet of which per unit shall be landscaped with shrubs and lawns and located in the front setback of the property.

C.

The distance between the main buildings and accessory buildings shall not be less than ten feet.

D.

Where a roadway is provided in a court, place, or side yard for off-street access, the width for such roadway shall be in addition to other space requirements of this chapter and in no case less than 20 feet in width.

E.

All roadways and parking spaces shall be of dust-free nature, surfaced with either concrete or asphalt type substance clearly marked and identified.

F.

Garbage containers shall be placed on the alley side of units on concrete pads as determined by the development review committee.

Sec. 17.32.080. - Density.

The ratio of dwelling units to land area. Density in row housing, condominiums, townhouses and other such multiple-family dwellings is limited to 16.5 dwelling units per acre of land; the density of all other residential uses is limited to eight dwelling units per acre of land.
