36 MULTIPLE-FAMILY RESIDENTIAL ZONE R-3

17.36.010 Purpose And Intent

The purpose of the R-3 zone classification is to provide residential areas that will accommodate the development of dwelling types from single-family through multiple-family units with their associated necessary public services and activities. It is also to provide an orderly transition from less intensive, lower density uses to more intensive, higher density uses.

17.36.020 Permitted Uses

Permitted uses in the R-3 zone include:

  1. Accessory building and use customarily incidental to any permitted use;
  2. Agriculture;
  3. Apartment dwelling with twenty-four (24) or fewer dwelling units;
  4. Boarding or lodging house;
  5. Church, synagogue or similar permanent building used for regular religious worship;
  6. Educational institution;
  7. Golf course, except miniature golf course;
  8. Greenhouse, noncommercial only;
  9. Group dwellings with twenty-four (24) or fewer dwelling units, in accordance with Chapter 17.100
  10. Home occupation;
  11. Household pets;
  12. Library, museum, public or nonprofit;
  13. Multiple-family dwelling with twenty-four (24) or fewer dwelling units;
  14. Parking lots accessory to uses permitted in this zone;
  15. Planned residential unit development in accordance with Chapter 17.92
  16. Public building; public park, recreation grounds and associated buildings;
  17. Single-family dwelling;
  18. Temporary building for use incidental to construction work. Such building shall be removed upon completion or abandonment of the construction work;
  19. Two-family dwelling.

17.36.030 Conditional Uses

The following uses shall be permitted only when authorized by a conditional use permit as provided in Chapter 17.88:

  1. Apartment dwelling with twenty-five (25) or more dwelling units;
  2. Cemetery with customary incidental uses including but not limited to mortuary, mausoleum, crematory, staff housing, service shops and chapel;
  3. Day care center;
  4. Fraternal and beneficial societies, orders and social clubs of a nonprofit nature;
  5. Group dwelling with twenty-five (25) or more dwelling units in accordance with Chapter 17.100
  6. Hospital, sanitarium or clinic;
  7. Kindergarten;
  8. Multiple-family dwelling with twenty-five (25) or more dwelling units;
  9. Nursing home, nursery for children;
  10. Private park, playground or recreation area, but not including privately owned commercial amusement business;
  11. Professional and business offices in which goods or merchandise are not commercially created, exchanged or sold;
  12. Public utility substation;
  13. Studio for professional work, teaching, performances or exhibitions of the fine arts, provided that such performances or exhibitions are limited to the work product of the studio involved;
  14. Wedding chapel, provided that light refreshment only shall be served and the service or consumption of food or refreshment shall be strictly incidental to the principal use.

17.36.040 Site Development Standards

Site development standards in the R-3 zone include:

  1. Minimum lot area:
    1. One-building dwelling: six thousand (6,000) square feet for single-family, seven thousand five hundred (7,500) square feet for two-family. For multiple-family, seven thousand five hundred (7,500) square feet plus two thousand (2,000) square feet for each dwelling unit in excess of two; for apartment dwelling, same as above plus one thousand (1,000) square feet for each occupant in excess of four in each dwelling unit,
    2. Group dwelling: seven thousand five hundred (7,500) square feet for each building plus two thousand (2,000) square feet for each dwelling unit in excess of two in each building; for apartment dwelling, same as above plus one thousand (1,000) square feet for each occupant in excess of four in each dwelling unit,
    3. Other main building: seven thousand five hundred (7,500) square feet. For nursing home, an additional seven hundred fifty (750) square feet for each guest or patient accommodation in excess of four;
  2. Minimum lot width: sixty (60) feet;
  3. Minimum yard setbacks:
    1. Front: twenty-five (25) feet, except average of existing buildings where fifty (50) percent frontage is developed, but not less than twenty (20) feet,
    2. Side:
      1. Main building:
        1. One-building dwelling and group dwelling: eight feet with total width of two required yards of not less than eighteen (18) feet, plus one foot each side for each one foot main building that is over thirty-five (35) feet high,
        2. Other main building: twenty (20) feet each side plus one foot each side for each one foot building that is over thirty-five (35) feet high,
      2. Accessory building: eight feet, except one foot if located at least six feet from rear of main building, but not closer than eight feet to dwelling on adjacent lot.
    3. Side facing street on corner lot: twenty (20) feet, except average of existing buildings where fifty (50) percent frontage is developed, but not less than fifteen (15) feet,
    4. Rear:
      1. Main building: thirty (30) feet,
      2. Accessory building: one foot, except eight feet where accessory building rears on side yard of adjacent corner lot;
  4. Building height:
    1. Minimum: one story,
    2. Maximum: Nursing home two and one-half stories or thirty-five (35) feet; none for other buildings;
  5. Lot coverage: No building or group of buildings with their accessory buildings shall cover more than forty (40) percent of the lot area;
  6. At least forty (40) percent of the lot area shall be left in open green space;
  7. In no case shall the ratio of total floor area in the building to the total lot area exceed one to one (1:1).
  8. The definition of a Manufactured Home and a Mobile Home shall be as set forth in Section 15A-1-302 of the Utah Code, as amended.
    1. The placement of Mobile Homes shall be restricted to Mobile Home parks. Manufactured Homes shall only be authorized in Mobile Home Parks unless they are placed on a permanent foundation, meet current building code requirements and have outside dimensions of not less than 24 feet wide by 40 feet long.

17.36.050 Sign Regulations

The height, size and location of the following permitted signs shall be in accordance with the regulations set forth in Chapter 17.76:

  1. Construction project sign;
  2. Directional sign;
  3. Flat sign;
  4. Freestanding sign;
  5. Identification and information sign;
  6. Nameplate;
  7. Temporary sign.
