112 RESIDENTIAL FACILITIES FOR PERSONS WITH A DISABILITY

17.112.010 Definitions

As used in this chapter:

"Disability" means a physical or mental impairment that substantially limits one or more of a person's major life activities, including a person having a record of such an impairment or being regarded as having such an impairment, but it does not include current illegal use of or addiction to any federally controlled substance as defined in 21 U.S.C. 802.

"Residential facilities for persons with a disability" (hereafter "facility") means a residence in which more than one person with a disability resides, that is licensed or certified by the Department of Human Services under Title 62A, Chapter 2, Licensure of Programs and Facilities.

17.112.020 Requirements

Residential facilities for persons with disabilities shall be a permitted use in all zones wherein residential dwellings are allowed, subject to the following requirements:

  1. All applicable building, safety, zoning and health ordinances applicable to similar dwellings must be met;
  2. No other residential facility for persons with a disability or residential facility for elderly persons, as described in Section 10-9-501, et seq., Utah Code, as amended, shall be located within three-quarters of a mile of the proposed facility; and
  3. All required state licensing is maintained.
