16 ESTABLISHMENT OF ZONES

17.16.010 Establishment Of Zones

For the purpose of this zoning ordinance, the city is divided into the following zones in which land uses shall be limited as specified in this title. Classification will be determined on the basis of location, topographic features and other reasonable considerations to guide the orderly physical growth, neighborhood compatibility and overall stability of the city:

  1. Agricultural zone A-1;
  2. Agricultural business zone A-B;
  3. Single-family residential zone R-1;
  4. Two-family residential zone R-2;
  5. Multiple-family residential zone R-3;
  6. Mobilehome park zone R-MH;
  7. Neighborhood commercial zone C-1;
  8. Community commercial zone C-2;
  9. Highway commercial zone C-H;
  10. Planned neighborhood commercial zone CP-1;
  11. Planned community commercial zone CP-2;
  12. Light manufacturing zone M-1;
  13. Heavy manufacturing zone M-2;
  14. Planned light manufacturing zone MP-1;
  15. Planned heavy manufacturing zone MP-2;
  16. Open space zone O-1.

17.16.020 Boundaries Of Zones

The boundaries of each of the said zones are established as described herein or as shown on the map entitled "zoning map of Salina City, Utah," or as hereafter amended, a copy of which is attached to the ordinance codified in this title, and all boundaries, notations, and other data shown on said map are made by this reference as much a part of this title as if fully described and detailed herein. Said map shall be filed in the custody of the city recorder and may be examined by the public subject to any reasonable regulations established by the city recorder.

17.16.030 Rules Applicable Where Boundaries Uncertain

Where uncertainty exists as to the boundary of any zone, the following rules shall apply:

  1. Wherever the zone boundary is indicated as being approximately upon the center line of a street, alley or block, or along a property line, then unless otherwise definitely indicated on the map, the center line of such street, alley or block, or such property line, shall be construed to be the boundary of such zone.
  2. Wherever such boundary line of such zone is indicated as being approximately at the line of any river, irrigation canal, or other waterway, or railroad right-of-way, or public park or other public land, or any section line, then in such case the center of such stream, canal or waterway, or the boundary line of such railroad right-of-way or the boundary line of such public land or such section line shall be deemed to be the boundary of such zone.
  3. Where such zone boundary lines cannot be determined by the above rules, their location may be found by the use of the scale appearing upon the map.
  4. Where the application of the above rules does not clarify the zone boundary location, the board of adjustment shall interpret the map.

17.16.040 Zone Change Procedure

  1. Prior to starting the Zone Change Procedure, all applicants must complete a Zone Change Application and the fee of fifty dollars ($50.00) payable to Salina City. Applications are available at the Salina City Office.
  2. All property owners within the listed block boundaries shall be notified of the following zone change. Salina City will mail each property owner a first class letter requesting their personal opinion on the zone change. Property owners will be asked to fill out the letter and return it to Salina City Office no later than seven business days after the postmark date. Letters that are not returned within the seven business days will be considered a yes vote. All returned letters will be kept confidential and reviewed only by the Planning and Zoning Committee at their scheduled meeting. The returned letters must contain eighty (80) percent approval in order for the zone change process to continue. With the eighty (80) percent approval Salina City will notify the property owners on the date and location of the Planning and Zoning meeting that will consider rezoning the listed property. Such notification shall be made not less than fifteen (15) days prior to any such meeting. If the letters contain less than eighty (80) percent approval, Salina City will notify the property owners that their property will not be rezoned.
