26 AGRICULTURAL ZONE-RESIDENTIAL ZONE AR-1

17.26.010 Purpose And Intent

The purpose of the AR-1 zone is to provide a low-density residential development with animal rights. This zone must be adjacent to an existing A-1 or AR-1 zone. (ZO § 14-1)

17.26.020 Permitted Uses

Permitted uses in the AR-1 zone include:

  1. Accessory building or use customarily incidental to any permitted use;
  2. Agriculture;
  3. Cemetery;
  4. Church synagogue or similar permanent building used for regular religious worship;
  5. Greenhouse and nursery limited to sales of materials produced on premises and with no retail shop operation;
  6. Home occupation;
  7. Household pets;
  8. Parking lot accessory to uses permitted in this zone;
  9. Private park, playground or recreation area but not including privately owned commercial amusement business;
  10. Public building; public park, recreation grounds and associated building;
  11. Single-family dwelling;
  12. Temporary buildings or use incidental to construction work. Such building shall be removed upon completion or abandonment of the construction work. (Ord. 001001 § 2, 2000; ZO § 14-2)

17.26.030 Animal Restrictions

Animal restrictions in the AR-1 zone include:

  1. No animals or fowl shall be kept or maintained closer than forty (40) feet from any dwelling, and not closer than seventy-five (75) feet from any dwelling on adjacent lot. Any barn, coop, or enclosure structure for the housing or keeping of animals or fowl shall be kept, constructed or maintained not less than seventy-five (75) feet from a public street and not less than twenty (20) feet from any lot line. All animals shall be fenced or contained so as to keep them at least ten (10) feet from the high water marks of Salina Creek and the Sevier River where properties adjoin the same.
  2. Animal manure may not exceed twelve (12) inches from original ground level and may not protrude onto the neighbor's property. Corrals and pens must be kept clean and manure must be removed at least annually.
  3. Horse, cow, sheep, goats, chickens, rabbits, ducks, lama, and geese are permitted. All other animals must be approved by the Salina City Planning and Zoning Committee.
  4. Pigs, roosters, or mature bulls; or animals exceeding two thousand (2,000) pounds cannot be housed within Salina City limits.
  5. Animals must reside in the rear of the dwelling.
  6. Animal owner must reside on property with the exception of a bordering adjacent lot of the owners.
  7. A fence that surrounds an animal enclosure must be erected and maintained at least four feet high but no more than seven feet high. Fences must be constructed with a solid bar at the four-foot height of the fence such as a metal pipe or wood which cannot be flexed more than one and a half (1½) inches. Fencing must be constructed at least two or more feet from property lines except for adjoining or adjacent properties that house animals on each side of the fence where one fence, on the property line can be shared. If one or both property owners of the adjoining or adjacent lots disagree with sharing the same fence that is constructed on the property line that houses animals on both sides, an additional fence must be constructed on both properties at least two or more feet from the property line.
  8. A maximum of two animal units are permitted per twenty thousand (20,000) square feet. See definition section on animal units.
  9. All property owners within the listed block boundaries shall be notified of the following zone change. Salina City will mail each property owner a first class letter requesting their personal opinion on the zone change. Property owners will be asked to fill out the letter and return it to Salina City Office no later than seven business days after the postmark date. Letters that are not returned within the seven business days will be considered a yes vote. All returned letters will be kept confidential and reviewed only by the Planning and zoning committee at their scheduled meeting. The returned letters must contain eighty (80) percent approval in order for the zone change process to continue. With the eighty (80) percent approval Salina City will notify the property owners on the date and location of the planning and zoning meeting that will consider rezoning the listed property. Such notification shall be made not less than fifteen (15) days prior to any such meeting. If the letters contain less than eighty (80) percent approval, Salina City will notify the property owners that their property will not be rezoned.
  10. All previous Grandfather Rights are void when property is rezoned.

17.26.040 Site Development Standards

Site development standards in the AR-1 zone include:

  1. Minimum lot area: twenty thousand (20,000) square feet, excluding existing developed lot;
  2. Minimum lot width: eighty (80) feet, excluding existing developed lot;
  3. Minimum yard setbacks:
    1. Front: thirty (30) feet, excluding existing developed lot, except average of existing building where fifty (50) percent frontage is developed, but not less than twenty (20) feet;
    2. Side:
      1. Dwelling: ten (10) feet with total width of two side yards not less than twenty-four (24) feet;
      2. Other main building: twenty (20) feet each side;
    3. Accessory building: ten (10) feet, from property line and or dwelling.
    4. Side facing street on corner lot: twenty (20) feet, except average of existing buildings where fifty (50) percent frontage is developed, but not less than fifteen (15) feet;
    5. Rear:
      1. Main building: thirty (30) feet;
      2. Accessory building: two feet, except ten (10) feet where accessory building rears on side yard of adjacent corner lot;
      3. Building height:
        1. Minimum: one story;
        2. Maximum: two and one-half stories or thirty-five (35) feet.

  1. Animal units:
    1. One unit equals one horse.
    2. One unit equals one cow.
    3. One unit equals two sheep.
    4. One unit equals two goats.
    5. One unit equals ten chickens.
    6. One unit equals ten rabbits.
    7. One unit equals five ducks.
    8. One unit equals two geese.
    9. One unit equals one lama.
