77 WIND ENERGY CONVERSION SYSTEMS


Editor's note—Ord. No. 090301, adopted Mar. 11, 2009, enacted new provisions to read as a new Chapter 17.76, but that chapter has been set out as "Sign Regulations". In keeping with the numbering style of the Code, provisions from Ord. No. 090301 have been set out as a new Chapter 17.77.

17.77.010 Purpose And Objectives

The wind energy conversion system regulations are intended to impose conditions and requirements with respect to the location and construction of wind energy conversion systems within the city in order to promote the general welfare and safety of residents of the city.

17.77.020 Approval Of WECS

Wind energy conversion systems, hereinafter referred to as "WECS", may be approved by the planning commission as a conditional use in the A-1, R-1, R-2, C-1, C-2, IM-1, IM-2, and IM-3 zones if all of the following conditions are met:

  1. A site plan shall be submitted to the planning department. Such site plan shall be drawn to a scale of not less than one inch equals ten feet (1" = 10') and shall show all property lines, structures on the applicant's property and adjacent properties, overhead utilities and easements and rights of way on or adjacent to the applicant's property, and any other information deemed necessary by the planning and zoning committee.
  2. Height of a WECS shall not exceed forty-five (45) feet including the blade length. Height shall be the distance from the highest point of the WECS to the top of curb or crown of road where no curb exists.
  3. A WECS shall not be closer to any property line than its total height plus 1.5 x its blade length. At no time shall a WECS be permitted closer than its height plus 1.5 x its blade length from any dedicated public right of way or easement.
  4. The WECS shall not cause any interference to any existing microwave transmitters and /or receivers.
  5. All property owners within five hundred feet (500) of the applicant's property lines shall be notified by signing a petition in allowing the WECS to be placed. The petition must obtain an eighty (80) percent or higher approval rate. Applicant must notify the property owners on the date and location of the planning and zoning meeting that will consider a WECS application. Such notification shall be made not less than fifteen (15) days prior to any such meeting and shall be at the expense of the applicant.
  6. The applicant shall furnish elevation drawings and/or photographs of the proposed WECS.
  7. The applicant shall furnish any other information required by the planning and zoning committee.
  8. Pole or Tower Design. The design of the small WECS shall be a monopole or freestanding design no guy wired tower.
  9. No tower shall have any climbing apparatus within fifteen (15) feet of the ground. All access doors or access ways to towers and electrical equipment shall be locked at all time.
  10. Appropriate warning signage shall be placed on towers, electrical equipment and WECS entrances.
  11. Communication and electrical: Each Wind Turbine shall be set back from the nearest above ground public electric power line or telephone line a distance no closer than its height plus 1.5 x its blade length, determined from the existing power line or telephone line.
  12. A WECS must be installed by a professional installer approved by the manufacture.

17.77.030 Permit Issuance Required

It is unlawful for any person, whether acting as owner, occupant or otherwise, to erect, construct, reconstruct, enlarge, locate or install any WECS within the city, contrary to any provision of this chapter, without first complying with the approval requirements specified herein, and obtaining a permit from the Sevier County Building Inspector. Said permit shall not be issued until such time as a conditional use has been granted by Salina City Planning and Zoning Committee.

17.77.040 WECS Permit Application

The application for a WECS permit shall be submitted to the building inspector, which application shall include the following:

  1. Two complete sets of detailed plans and specifications for the WECS, which shall include a structural land and electrical design completed by a registered professional engineer whose seal shall be affixed to all such drawings and plans.
  2. Specific details of an override protection system designed to control blade rotation at such time that wind speed exceeds forty (40) miles per hour.
  3. A soils report prepared by a registered professional engineer.

17.77.050 Connection To A Public Utility

Any connection to a public utility shall be made under the supervision of the authorized representative of such public utility and must be in compliance with Utah National Electric Code. Written notice of connection by the aforesaid public utility shall be delivered to the Sevier County Building Inspector prior to making of the final inspection of the WECS.

17.77.060 Noise

No WECS shall exceed sixty decibels (60 dBA) as measured at the property line or fifty decibels (50 dBA) measured at the nearest neighboring inhabitable building.

17.77.070 Visual Appearance

  1. WECS shall be finished in a rust-resistant, non-obtrusive finish, and a neutral color that is non-reflective.
  2. No WECS shall be lighted unless required by the Federal Aviation Administration.
  3. No advertising signs of any kind shall be permitted on any WECS.
  4. Appropriate landscaping shall be provided for approval with the application of a building permit.
