CHAPTER 1230

PURPOSE AND INTERPRETATION13

Sec. 1230-01.- Short title.

This Title Six of Part Twelve - the Planning and Zoning Code, including the Zoning District Map made a part hereof, shall be known and may be cited and referred to as The Village of University Park Zoning Ordinance of 1970, or just the Zoning Code.

Sec. 1230-02. - Purpose and intent.

(a)

This Zoning Code is adopted to the end that:

(1)

Adequate natural light, pure air, privacy, convenience of access to property, and safety from fire, explosion, noxious fumes, panic and other dangers may be secured;

(2)

Overcrowding of land may be prevented;

(3)

Undue concentration of population may be avoided;

(4)

Value of land and structures throughout the Village may be conserved;

(5)

Congestion in the public streets and highways may be lessened or avoided;

(6)

Hazards to persons and damage to property resulting from the accumulation or runoff of storm or flood waters may be lessened or avoided;

(7)

Aesthetic values throughout the Village may be preserved and enhanced;

(8)

Public health, safety, comfort, morals, convenience and general welfare may otherwise be promoted; and

Energy conservation practices may be encouraged.

(b)

To achieve these ends, the Zoning Code sets forth regulations and standards to:

(1)

Encourage the most appropriate use of land throughout the Village;

(2)

Regulate and limit the height and bulk of structures hereafter to be erected;

(3)

Establish, regulate and limit setback lines along streets;

(4)

Regulate the intensity of land use and determine the area of permanent open space;

(5)

Classify, regulate and restrict the location of trades and the location of structures designed for business, industrial, residential and other specified uses;

(6)

Divide the Village into zoning districts of such character, number, shape and area, as are best suited to effect the foregoing purposes;

(7)

Prohibit structures or uses incompatible with the character of such districts;

(8)

Prevent additions to and alterations or remodeling of existing structures in such a way as to avoid the restrictions and limitations lawfully imposed in this Zoning Code;

(9)

Fix standards to which structures shall conform;

(10)

Provide for the gradual elimination of structures and uses which are incompatible with the character of the districts in which they are located;

(11)

Define and limit the powers and duties of the administrative officers and bodies as provided in this Zoning Code; and

(12)

Prescribe penalties for the violation of the provisions of this Zoning Code.

Sec. 1230-03. - Interpretation of Zoning Code.

In their application, the provisions of this Zoning Code shall be held to be the minimum requirements for the promotion and protection of the public health, safety, morals and general welfare, and the provisions shall be interpreted in accordance with the following:

(a)

Where the conditions imposed by any provision of this Code are either more restrictive or less restrictive than comparable standards imposed by any other provision of this Code or by any other law, ordinance, resolution, rule or regulation of any kind, the regulations which are more restrictive or which impose higher standards or requirements shall govern.

(b)

This Code is not intended to abrogate any ordinance, permit, easement, covenant or other private agreement, provided that where the regulations of this Code are more restrictive or impose higher standards or requirements than such ordinance, permit, easement, covenant or other private agreement, the requirements of this Code shall govern.

(c)

No structure or use not lawfully existing at the effective date of this section (Ordinance 115, passed October 23, 1970) shall become or be made lawful solely by reason of the adoption of this Code, and that if such unlawful structure or use is in conflict with the requirements of this Code, such structure or use remains unlawful hereunder.

Sec. 1230-04. - Separability.

It is hereby declared to be the intention of the President and the Board of Trustees that the several provisions of this Zoning Code are severable in accordance with the following:

(a)

If any court of competent jurisdiction adjudges any provision of this Code to be invalid, such judgment shall not affect any other provision of this Code not specifically included in such judgment.

(b)

If any court of competent jurisdiction adjudges invalid the application of any provision of this Code to a particular structure or use, such judgment shall not affect the application of such provision to any other structure or use not specifically included in such judgment.
