CHAPTER 1258

B3 COMMERCIAL DISTRICT29

Sec. 1258-01.- Purpose.

The B3 Commercial District is intended to accommodate a wide range of specialized commercial and business uses including highway-oriented service and commercial recreation types of establishments to serve a trade area embracing the Village and intercommunity traffic through the Village.

Sec. 1258-02. - Permitted uses.

Permitted uses shall be as follows:

(1)

Amusement establishments, i.e. bowling alleys, billiard parlors, gymnasiums, indoor ice skating rinks, indoor swimming pools and clubs and indoor recreation centers containing one (1) or more of the uses provided in this subsection;

(2)

Animal hospitals and veterinarian offices;

(3)

Automobile accessory stores;

(4)

Automobile diagnostic service centers;

(5)

Automobile service stations;

(6)

Bakeries, including sale of bakery products to stores, restaurants, clubs, hotels, institutions and similar establishments;

(7)

Battery and tire sales and service establishments;

(8)

Blueprinting and photo copy establishments;

(9)

Cartage, express and parcel delivery establishments, not including motor freight terminals;

(10)

Catering establishments;

(11)

Clubs, private, fraternal and religious;

(12)

Dry-cleaning and laundry establishments;

(13)

Contractors' offices and shops, including, but not limited to, heating, air-conditioning, plumbing, plating, sheet metal, tinsmith, not including open storage in front and side yards;

(14)

Exhibition halls;

(15)

Garages, storage or off-street parking lots and ramps, commercial or Municipal;

(16)

Laboratories, medical, dental, optical;

(17)

Linen, towel or diaper service establishments;

(18)

Mail order houses.

(19)

Meat provision, including sale of meats to restaurants, clubs, hotels, institutions and similar establishments;

(20)

Medical or dental clinics, including laboratories incidental thereto;

(21)

Meeting halls, convention or exhibition halls;

(22)

Monument sales;

(23)

Motor vehicle sales establishments;

(24)

Newspaper offices, including printing;

(25)

Nursing homes;

(26)

Packing and crating establishments;

(27)

Parcel delivery stations;

(28)

Physical culture and health establishments;

(29)

Printing, publishing or lithography establishments;

(30)

Restaurants and refreshment stands, drive-in;

(31)

Restaurants, which may include accessory cocktail lounges, entertainment and dancing;

(32)

Theaters, but not including outdoor drive-in theaters;

(33)

Undertaking establishments and funeral parlors;

(34)

Wholesale, jobbing and warehousing establishments;

(35)

Accessory uses, including, but not limited to:

(a)

Off-street parking and loading as regulated in Chapter 1270; and

(b)

Signs as regulated in Chapter 1272; and

(36)

Uses not explicitly enumerated in this section as permitted uses, but closely similar thereto, provided that such uses are not explicitly mentioned as permitted or special uses elsewhere in this Zoning Code; and

(37)

Retail sales of packaged liquor goods.

Sec. 1258-03. - Special uses.

Special uses shall be as follows:

(a)

Other uses similar to the permitted uses provided in Section 1258-02;

(b)

Garages, public, including painting, body and fender work and motor rebuilding;

(c)

Open sales lots;

(d)

Public utility and governmental service uses, lot areas and lot widths for the following uses shall be as recommended by the Plan Commission and approved by the Board of Trustees and may be lesser or greater in area or width than herein required in the district regulations:

(1)

Electric distribution centers;

(2)

Fire stations.

(3)

Gas regulator stations;

(4)

Police stations;

(5)

Radio and television towers and antennae;

(6)

Railroad rights-of-way and passenger stations;

(7)

Transit and public transportation facilities, including passenger shelters;

(8)

Telephone exchange buildings, microwave relay towers and telephone transmission equipment buildings;

(9)

Water filtration plants, pumping stations, reservoirs, towers and rights of way; and

(10)

Sewerage systems;

(e)

Radio and television towers, receiving or transmitting;

(f)

Accessory uses including, but not limited to:

(1)

Off-street parking and loading as regulated in Chapter 1270; and

(2)

Signs as regulated in Chapter 1272;

(g)

Planned developments;

(h)

Uses not explicitly enumerated in this section as special uses, but closely similar thereto, provided that such uses are not explicitly mentioned as permitted or special uses elsewhere in this Zoning Code.

Sec. 1258-04. - Yard depth.

Yard depth shall be as follows:

(a)

Front, not less than twelve (12) feet;

(b)

Side, two (2) side yards, neither of which is less than five (5) feet, except a side yard adjoining a street or residence district shall be not less than thirty (30) feet; and

(c)

Rear, not less than twenty (20) feet.

Sec. 1258-05. - Floor area ratio.

Floor area ratios shall not exceed one and two-tenths (1.2).
