CHAPTER 1254

B-1 LOCAL SHOPPING DISTRICT27

Sec. 1254-01.- Purpose.

The B1 Local Shopping District regulations are intended to provide areas and govern uses therein for a range of shopper and personal service types of establishments in order to serve the general shopping needs of a consumer population that is located in one (1) or more of the neighborhoods adjoining and in the vicinity of the shopping district.

Sec. 1254-02. - Permitted uses.

Permitted uses shall be as follows:

(1)

Art and school supply stores;

(2)

Bakeries, retail sales where not more than thirty (30) percent of the floor area may be devoted to processing of goods;

(3)

Barber shops;

(4)

Beauty parlors;

(5)

Book and stationery stores;

(6)

Camera and photographic supply stores;

(7)

Candy and ice cream stores;

(8)

China and glassware stores;

(9)

Clothes pressing establishments;

(10)

Coin and philatelic stores;

(11)

Currency exchanges;

(12)

Dressmaking establishments employing not more than five (5) persons at one time;

(13)

Drugstores;

(14)

Dry-cleaning and laundry-receiving stations, not including processing;

(15)

Dry goods stores;

(16)

Electrical and household appliance and fixture stores, including radio and television sales and service;

(17)

Florist shops and conservatories;

(18)

Food stores, including meat and fish markets, bakery shops and delicatessens;

(19)

Furniture stores;

(20)

Furrier shops, including incidental storage and conditioning of furs;

(21)

Gift shops;

(22)

Hardware stores;

(23)

Hobby shops, including only the retailing of items to be assembled or used away from the premises;

(24)

Interior decorating shops, including upholstery and the making of draperies, slipcovers and other similar articles as ancillary uses; floor space used for the processing of goods shall not occupy more than thirty percent of the total floor space of the establishment;

(25)

Jewelry stores;

(26)

Laundrettes, including automatic self-service drying and cleaning permit;

(27)

Men's apparel shops;

(28)

Leather goods and luggage shops;

(29)

Libraries, public and private;

(30)

Millinery shops;

(31)

Musical instrument stores, sales and repairs;

(32)

Music stores, phonographs, phonograph records, tape recorders, tapes and sheet music;

(33)

Newsstands;

(34)

Offices;

(35)

Office supply and equipment stores, sales and service;

(36)

Paint and wallpaper stores;

(37)

Photography studios;

(38)

Physical culture and health services;

(39)

Post offices and substations;

(40)

Restaurants, not including drive-ins;

(41)

Sewing machine stores, household, sales and service;

(42)

Shoe and hat repair shop, employing not more than five persons at one time;

(43)

Shoe stores;

(44)

Sporting goods stores;

(45)

Tailor shops;

(46)

Telephone booths and pedestals, outdoor;

(47)

Temporary buildings for construction purposes, for a period not to exceed the duration of such construction;

(48)

Ticket offices, amusement;

(49)

Tobacco shops;

(50)

Toy shops;

(51)

Transportation ticket offices;

(52)

Travel bureaus;

(53)

Variety and five-and-dime stores;

(54)

Vending machines, coin or currency operated;

(55)

Women's apparel shops;

(56)

Accessory uses, including, but not limited to:

(a)

Off-street parking and loading as regulated in Chapter 1270; and

(b)

Signs as regulated in Chapter 1272; and

(57)

Uses not explicitly enumerated in this section as permitted uses, but closely similar thereto, provided that such uses are not explicitly mentioned as permitted or special uses elsewhere in this Zoning Code.

Sec. 1254-03. - Special uses.

Special uses shall be as follows:

(a)

Other business uses similar to permitted uses listed in Section 1254-02;

(b)

Automobile service stations;

(c)

Banks and other financial institutions, including drive-in facilities;

(d)

Liquor stores, package;

(e)

Public utility and government service uses, lot areas and lot widths for the following uses shall be as recommended by the Plan Commission and approved by the Board of Trustees and may be lesser or greater in area or width than herein required in the district regulations:

(1)

Electric distribution centers;

(2)

Fire stations;

(3)

Gas regulator stations;

(4)

Police stations;

(5)

Radio and television towers and stations;

(6)

Railroad rights-of-way and passenger stations;

(7)

Transit and public transportation facilities, including passenger shelters;

(8)

Telephone exchange buildings, microwave relay towers and telephone transmission equipment buildings;

(9)

Water filtration plants, pumping stations, reservoirs, towers and rights-of-way; and

(10)

Sewerage systems;

(f)

Radio and television service and repair shops;

(g)

Restaurants, which may include accessory cocktail lounges;

(h)

Accessory uses, including, but not limited to:

(1)

Off-street parking and loading as regulated in Chapter 1270; and

(2)

Signs as regulated in Chapter 1272;

Sec. 1254-04. - Yards.

Yards shall be as follows:

(a)

Front, not less than twelve (12) feet in depth;

(b)

Side, no yard is required, however, if a yard is provided, it shall be not less than five (5) feet in depth, except a side yard adjoining a street shall be not less than thirty (30) feet in depth; and

(c)

Rear, not less than thirty (30) feet in depth.

Sec. 1254-05. - Floor area ratio.

Floor area ratios shall not exceed six-tenths.

Sec. 1254-06. - Building height.

Building height shall be not more than fifteen (15) feet or one (1) story, whichever is lower.
