B4 OUTDOOR COMMERCIAL DISTRICT30
The B4 Outdoor Commercial District is intended to accommodate outdoor commercial activities,
to regulate such activities and to preclude such activities from becoming a nuisance
to residences and businesses in the surrounding area, as well as to obviate concerns
about the noises emanating from such activities.

Permitted uses shall be as follows: All uses permitted in the B3 Commercial District.

Special uses shall be as follows:
(a)
All special uses permitted in the B3 Commercial District, subject to the conditions, requirements and specifications outlined for special uses in the B4 Outdoor Commercial District;
(b)
Amusement parks, including permanent carnivals, kiddie parks, arcades and similar outdoor recreational facilities, along with ancillary food service facilities, if any;
(c)
Archery ranges;
(d)
Baseball batting facilities (outdoor);
(e)
Beer gardens;
(f)
Bocci ball, horseshoes and other similar games used in connection with other facilities;
(g)
Clubs (outdoor);
(h)
Fairgrounds and exhibition grounds;
(i)
Go-kart race tracks;
(j)
Racetracks (car or horse);
(k)
Stables(commercial);
(l)
Stadiums, auditoriums, colosseum or arenas (open);
(m)
Swimming centers;
(n)
Tennis clubs, racquetball clubs and handball clubs, with outdoor facilities;
(o)
Theaters (drive-in);
(p)
Theaters for music, dance or drama (outdoor);
(q)
Water slides;
(r)
Zoos;
(s)
Picnic groves;
(t)
Campgrounds;
(u)
Ice skating rinks;
(v)
Miniature golf; and
(w)
Golf driving ranges.

Yard depth shall be as follows:
(a)
Front, not less than fifty (50) feet;
(b)
Side, two (2) side yards, neither of which is less than fifty (50) feet; and
(c)
Rear, not less than fifty feet.

As the uses listed in Section 1259-03 could, if not properly developed and maintained, have a detrimental effect on the surrounding property, the following factors shall be considered by the Plan Commission and the Board of Trustees in their deliberations on all special uses in the R4 Outdoor Commercial District:
(a)
That the establishment, maintenance or operation of the special use shall not be detrimental to or endanger the public health, safety or general welfare;
(b)
That the special use shall not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish or impair property values, nor be incompatible with other property within the neighborhood;
(c)
That the proposed development is compatible with the surrounding area's existing land use and zoning;
(d)
That the granting of the special use shall not impede the normal and orderly development and improvement of surrounding property;
(e)
That adequate utilities, access roads, drainage and/or other necessary facilities have been or are being provided, and that these shall not adversely affect adjacent properties;
(f)
That adequate measures shall be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets;
(g)
That adequate circulation and parking are provided and that traffic conditions shall not have a depreciating effect upon the value of surrounding property;
(h)
That the special use plans for buildings, lighting, parking and traffic control are understood by the petitioner to be reviewed for approval by staff and the Plan Commission;
(i)
That the petitioner understands that failure to comply with any or all of the conditions of the special use permit shall be adequate cause for revocation of any and all permits by the issuing Village departments or commissions;
(j)
That the special use will, in all other respects, conform to applicable Village regulations, except as such regulations may in each instance be modified by the Board of Trustees pursuant to the recommendation of the Plan Commission; and
(k)
The extent to which any formal written protest pertaining to the proposed special
use can be substantiated on a factual basis.

All special uses in the B4 Outdoor Commercial District shall be buffered as follows:
(a)
The entire perimeter of the development, other than driveways and areas adjacent to driveways, shall contain an intensely landscaped buffer of a minimum width of ten (10) feet.
(b)
The Plan Commission may recommend that the Board of Trustees require a fence within the buffer area required by subsection (a) hereof.
(c)
Lighting fixtures on driveways, walks and parking areas shall be of low intensity and shaded to avoid casting direct light beyond property lines.
(d)
No special use shall be granted within five hundred (500) feet of a church, school
or residentially zoned district, except an R5 District.

The following special requirements shall be applied to all special uses in the B4 Outdoor Commercial District:
(a)
Pedestrian paths shall be provided in all cases, with a minimum width of five (5) feet, depending upon the expected pedestrian usage based on occupancy.
(b)
Parking shall be provided in all cases, utilizing present Village standards for occupancy, plus adequate parking based on acreage and activity (theaters and amusement parks, for example) as recommended by the Plan Commission to the Board of Trustees.
(c)
Where buses, charters and trailer homes are expected to be utilized, a separate parking lot shall be required with adequate parking based on acreage and activity as determined by the Plan Commission. A specifically delineated loading and unloading zone shall be provided.
(d)
All entrances and exits shall be landscaped.
(e)
Driveways shall be provided to assist ingress and egress of parking lots. The number of lanes and the need for traffic signalization shall be dependent upon the type of use proposed, the location and expected traffic counts. Petitioners may be required to submit traffic studies to support their proposals.
(f)
Directional signs, not to exceed two square feet each, shall be required to give proper information to pedestrians and automobile traffic.
(g)
Areas which will support grass shall be prepared, graded, seeded and maintained. Areas immediately adjacent to the buildings or structures shall be sodded.
(h)
All newly installed public utilities shall be located underground.
(i)
All outdoor areas for the storage of trash shall be totally enclosed with a six-foot
high sightproof fence.

The minimum lot size for any permitted use or special use within the B4 Outdoor Commercial
District shall be five acres.
