CHAPTER 13

12 ZONING DISTRICTS GENERALLY


State law reference—Districts authorized, Minn. Stats. § 462.357, Subd. 1.

13.12.010 Establishment Of Districts

  1. The following zoning districts are hereby established within the City of Pine City:
    1. A-O Agricultural-Open Space District.
    2. R-1 Single-Family Residential District.
    3. R-1A Residential Cluster District.
    4. R-2 Two-Family Residential District.
    5. CLP Cross Lake Preserve
    6. FMD Fawn Meadows District
    7. MFR-1 Moderate Density Multifamily Residential District.
    8. MFR-2 Higher Density Multifamily Residential District.
    9. MHP-Manufactured Home Park District.
    10. MXU-Mixed Use District.
    11. CBD-Central Business District.
    12. GB-General Business District.
    13. HB-Highway Business District.
    14. TI-1-Limited Technology/Industrial District.
    15. TI-2-General Technology/Industrial District.
    16. PUD-Planned Unit Development District.
  2. In addition, the following districts supersede the aforementioned zoning and are detailed in PCC 13.88:
    1. S Shorelands District.
    2. FP Flood Plain District.
    3. W Wetlands District.

13.12.020 Map

The location and boundaries of the districts established by this chapter shall be set forth and on the zoning maps entitled "Zoning Map," a copy of which shall be filed with the City Administrator. The maps and all of the notations, references and other information shown thereon shall have the same force and effect as if fully set forth in this chapter and are thereby made a part of this chapter by reference.

13.12.030 Annexation; Detachment

In the event of changes in the City limits removing territory from the City, district boundaries shall be constructed as moving with City limits. In the event of annexation of new areas to the City, such; areas shall be considered to be in the A-O District until otherwise classified.

13.12.031 Voluntary Annexation From Pine City Township

AN ORDINANCE OF THE CITY OF PINE CITY, MINNESOTA ANNEXING
LAND LOCATED IN PINE CITY TOWNSHIP, PINE COUNTY, MINNESOTA
PURSUANT TO MINNESOTA STATUTES 414.033 SUBDIVISION 2(3),
PERMITTING ANNEXATION BY ORDINANCE

WHEREAS, a petition signed by all the property owners, requesting that property legally described (herein or attached exhibit) be annexed to the City of Pine City, Minnesota, was duly presented to the Council of the City of Pine City on the 7th day of June, 2023;
andWHEREAS, said property is unincorporated and abuts the City of Pine City on its eastern boundary; is less than 120 acres; is not presently served by public sewer facilities or public sewer facilities are not otherwise available; andWHEREAS, said property is not located within a flood plain or shoreland area; andWHEREAS, said property is currently farmland and annexation is requested to facilitate the extension of city services for the residential development of the property; andWHEREAS, the City of Pine City held a public hearing pursuant to Minnesota Statutes 414.033 Subd. 2b, on June 7, 2023 following thirty (30) days written notice by certified mail to the Town of Pine City and to all landowners within and contiguous to the area legally described (herein or attached exhibit), to be annexed; andWHEREAS, provisions of Minnesota Statutes S 414.033 Subd. 13 are not applicable in that there will be no change in the electric utility service provider resulting from the annexation of the territory to the municipality.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PINE CITY HEREBY ORDAINS AS FOLLOWS:1. The City Council hereby determines that the property as hereinafter described abuts the city limits and is or is about to become urban or suburban in nature in that residential use is being proposed for said property the construction of which requires or will need city services, including public sewer facilities.2. None of the property is now included within the limits of any city, or in any area that has already been designated for orderly annexation pursuant to Minnesota Statute S414.0325.3. The corporate limits of the City of Pine City, Minnesota, are hereby extended to include the following described property, said land abutting the City of Pine City and being '120 acres or less in area, and is not presently served by public sewer facilities or public sewer facilities are not otherwise available, and the City having received a petition for annexation from all the property owners of the land, to wit: Lots 3, 4, and 5 Auditors Subdivision of Section 3, Township 38, Range 21, Pine County, MN

The above described property consists of a total of 62.3 acres, more or less. Copies of the corporate boundary map showing the property to be annexed and its relationship to the corporate boundaries and all appropriate plat maps are attached hereto.

4. That the population of the area legally described (herein or attached exhibit) and hereby annexed is zero (0).
5. The City of Pine City, pursuant to Minnesota Statute 414.036, that with respect to the property taxes payable on the area legally described (herein or attached exhibit), hereby annexed, shall make a cash payment to the Town of Pine City in accordance with the following schedule.:

Option A:
A. In the first year following the year in which the City of Pine City could first levy on the annexed area, and amount equal to $172.12; and B. In the second year, an amount equal to $172.12

Option B:
Parties may agree to other payment terms. Include written documentation of such an agreement.

6. That pursuant to the Minnesota Statute 414.036 with respect to any special assessments assigned by the Town to the annexed property and any portion of debt incurred by the Town prior to the annexation and attributable to the property to be annexed, but for which no special assessments are outstanding, for the area legally described (herein or attached exhibit) there are no special assessments or debt incurred by the Town on the subject are for which reimbursement is required.

7. That the City Clerk of the City of Pine City is hereby authorized and directed to file a copy of this Ordinance with the Municipal Boundary Adjustment Unit of the Office of Administrative Hearings, the Minnesota Secretary of State, the Pine County Auditor, and the Pine City Township Clerk.

8. That this Ordinance shall be in full force and effect and final upon the date this Ordinance is approved by the Office of Administrative Hearings.

13.12.040 Zoning District Boundaries

  1. Boundaries indicated as approximately following the centerlines of streets, highways, alleys, or railroad lines shall be construed to follow such centerlines.
  2. Boundaries indicated as approximately following plotted lot lines shall be construed as following such lot lines.
  3. Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in shoreline shall be constructed as moving with the actual shoreline; boundaries indicated as approximately following the centerlines of streams, rivers, lakes, or other bodies of water shall be construed as following such centerlines.
  4. Boundaries indicated as approximately following the City limits shall be construed as following such City limits.
  5. Where a district boundary line divides a lot that was in a single ownership at the time of passage of this chapter, the extension of the regulations for either portion of the lot may be interpreted by the Zoning Administrator upon request of the owner.
  6. The exact location of all district boundaries shall be interpreted by the Zoning Administrator, subject to appeal as provided in this chapter.

13.12.050 District Regulations

The regulations of this chapter within each district shall be minimum regulations, and shall apply uniformly to each class or kind of structure of land, except as hereinafter provided.

  1. No buildings, structure, or land shall hereafter be used or occupied, and no building structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered except in conformity with all of the regulations herein specified in this chapter for the district in which it is located.
  2. No buildings or other structure shall hereafter be erected or altered to exceed the height or bulk, to accommodate or house a greater number of families, to occupy a greater percentage of lot area, to have narrower or smaller rear, front, or side yards, or other open spaces than herein required; or in any other manner contrary to the provision of this chapter.
  3. No yard or lot existing at the time of passage of this chapter shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of the ordinance from which this chapter is derived shall meet at least the minimum requirements established by this chapter.
