Auto Service Project Redevelopment Option Zone
(1) The Edgemont Auto Service (“EAS”) Project Redevelopment Option (“PRO”) zone is created to allow a long-existing, nonconforming business that continues to provide needed services to expand and modernize in order to:
(a) compete economically, and
(b) achieve a development pattern which is more compatible with development in surrounding residential areas than is possible under a nonconforming status in another zone.
(2) Architecture in the EAS PRO zone should strongly reflect traditional residential themes found in surrounding residential neighborhoods.
(1) Those uses or categories of uses as listed herein, and no others, are permitted in the EAS Project Redevelopment Option zone.
(2) All uses listed herein are listed by numbers as designated in the Standard Land Use Code published and maintained by the Planning Commission. Specific uses are identified by a four (4) digit number in which all digits are whole numbers. Classes or groupings of such uses permitted in the zone are identified by a four (4) digit number in which the last one (1) or two (2) digits are zeros.
(3) All such categories listed herein and all specific uses contained within them in the Standard Land Use Code shall be permitted in the EAS PRO zone, subject to the limitations set forth in this Chapter.
(4) Permitted Principal Uses. The following principal uses and structures are permitted in the EAS PRO zone.
(5) Non-automotive accessory uses of any kind shall be prohibited; provided, however, that up to fifty (50) square feet of a customer sales waiting area may be used for the sale of fountain drinks and snacks. A convenience store shall be prohibited.
All land within a given development located in the EAS PRO zone shall be under the ownership and control of a single individual, partnership, corporation, and other recognized legal entity to:
(1) provide for integrated development and ongoing supervision and control of the development, and
(2) ensure conformance with the provisions of this Chapter and any conditions imposed upon an associated preliminary or final project plan.
(1) The minimum area for a lot in the EAS PRO zone shall be the same area as existing when a lot is rezoned to the EAS PRO zone. No expansion of an existing lot shall occur unless accomplished pursuant to a rezoning by action of the Municipal Council.
(2) Lot width shall be not more than one hundred forty-five (145) feet.
(3) Lot depth shall be not more than two hundred (200) feet.
Each lot in the EAS PRO zone shall have public street frontage of at least two hundred (200) feet.
The following minimum yard requirements shall apply in the EAS PRO zone:
(1) Front Yard. Each lot or parcel shall have a front yard of at least twenty (20) feet.
(2) Side Yard, Interior Lot. Each lot or parcel shall have a side yard of at least ten (10) feet.
(3) Side Yard, Corner Lot. Each lot or parcel located on a corner lot shall have a street side yard of at least twenty (20) feet.
(4) Rear Yard. Each lot or parcel shall have a rear yard of at least thirty (30) feet.
(1) The following structures may be erected on, or project into, any required yard, except into a required driveway:
(a) fences and walls in conformance with the Provo City Code and other City codes and ordinances;
(b) landscaping elements including trees, shrubs, and other plants; and
(c) necessary appurtenances for utility service.
(2) The structures listed below may project into a minimum front or rear yard not more than four (4) feet, and into a minimum front or rear yard not more than two (2) feet, except that required driveways shall remain unobstructed from the ground upward:
(a) cornices, eaves, belt courses, sills, buttresses, or other similar architectural features, and
(b) door steps, fire escapes, awnings, and planter boxes or masonry planters not exceeding twenty-four (24) inches in height.
(3) A canopy for the purpose of sheltering gasoline fueling stations may project into a front or street side yard not more than ten (10) feet.
(1) Garbage containers and collection shall be provided by private companies contracted by the property owner.
(2) Garbage containers shall be stored within an enclosed building. Storage of materials shall be within an enclosed building.
(3) All merchandise, including auto accessories and tires, shall be displayed only inside a building located on the premises except that during business hours tires, oil, and windshield wipers may be displayed outside within two (2) feet of the front wall of the building.
(1) The EAS PRO zone shall have a minimum of four (4) parking spaces for each service bay. All parking shall meet all other requirements as set forth in Chapter 14.37, Provo City Code, except as described in Subsection (2) of this Section.
(2) Parking spaces may be located within a required front, street side and rear yard provided such parking does not encroach into an area of required landscaping.
(3) Every vehicle being serviced by a business located in the EAS PRO zone shall be stored within a designated parking space or building located on the property. No such vehicles shall be parked on a public street or in an area not designated for parking or such vehicles.
(4) Employees of any business located in the EAS PRO zone shall park on-site only.
Each development in the EAS PRO zone shall comply with the provisions of Sections 14.02.090 (Project Plan Required) and 14.34.280 (Design Review), Provo City Code. All structures shall receive approval from the Design Review Committee prior to the issuance of a building permit.
(1) Building Requirements.
(a) Development design shall include variety among individual building colors and textures. Building forms and landscape materials shall be harmonious with existing neighborhood dwellings. Architectural features should enhance individual identity of each building.
(b) Roof shapes shall harmonize with the architectural character of other buildings within the vicinity.
(c) Building materials shall be durable and suitable for the design in which they are used.
(2) Signage. Each sign erected in the EAS PRO zone shall be in conformance with the provisions of Section 14.38.080, Provo City Code.
(3) Landscape Requirements. Landscaping shall be provided in accordance with Chapter 15.20, Provo City Code, except as otherwise provided in this Subsection.
(a) Planting areas of not less than three hundred (300) square feet shall be provided in front yard areas. Such planting areas shall consist of at least one (1) tree, meeting the requirements of Chapter 15.20, Provo City Code, and shall be landscaped with sod or other acceptable flowers and shrubs.
(b) Front and interior side yard property lines shall be landscaped with a minimum three (3) foot wide planting area and filled with low-lying shrubs, flowers and/or hedges except where approved drive approaches are permitted.
(c) A street side yard shall include a bermed landscaped area, at least ten (10) feet wide which includes shrubs, flowers and/or hedges except where approved drive approaches are permitted. A minimum of one (1) tree, meeting the standards of Chapter 15.20, Provo City Code, per twenty-five (25) feet of street frontage shall be provided.
(d) Landscaping is not required in a rear yard except as shown on an approved preliminary project plan.
(4) Lighting. Prior to the issuance of a building permit, outdoor lighting plans shall be submitted that conform to the provisions of Chapter 15.21, Provo City Code.
(1) Structural fences six (6) feet or less in height shall not require a building permit. Structural fences over six (6) feet in height shall require a building permit from the Building Inspection Division. A structural or vegetative fence shall not create a sight distance hazard to vehicular or pedestrian traffic as determined by the Provo City Traffic Engineer.
(a) Front Yard. Solid walls, fences, hedges or screening materials which are sight obscuring may be built to a maximum of three (3) feet in height in any required front yard. Such walls, fences, hedges or screening materials may slope upward to connect with a higher side yard fence. The length of a sloped fence section shall not exceed one (1) section or a maximum of ten (10) feet.
(b) Side Yard. Solid, sight-obscuring fences or walls and non-sight-obscuring fences (at least fifty percent (50%) open) shall be eight (8) feet in height. A building permit shall be obtained from the Building Inspection Division prior to construction.
(c) Rear Yard. Walls and fences in a rear yard shall be eight (8) feet in height. A building permit shall be obtained from the Building Inspection Division prior to construction.
(d) Side Yard - Corner Lots. Solid walls, fences, hedges or screening materials which are sight obscuring may be built to a maximum of three (3) feet in height in any required street side yard. Such walls, fences, hedges or screening materials may slope upward to connect with a higher rear yard fence. The length of a sloped fence section shall not exceed one (1) section or a maximum of ten (10) feet.
Between the hours of 8:00 p.m. and 7:00 a.m. no activity shall be conducted which generates a sound which is audible at the property boundary.
