Town Homes Project Redevelopment Option Zone
(1) Dwelling unit occupancy in the Century Town Home PRO zone shall be limited to family occupancy as defined by this Title. Not withstanding any contrary provision in this Title, no accessory apartment or second kitchen shall be permitted in any dwelling unit.
(2) Parking shall be limited to two (2) spaces per dwelling unit and each unit shall be limited to not more than two (2) vehicles. No recreational vehicles shall be stored on property outside of an enclosed garage.
The purpose of the Century Town Homes Project Redevelopment Option (PRO) zone is to allow home ownership revitalization development in the Foothills neighborhood of East Provo which includes individual ownership attached dwelling units. This zone has been created to implement the goals of the General Plan to revitalize a historic neighborhood with owner-occupancy and to remove blighted rental and incompatible residential properties. The standards set forth herein are intended to encourage long term stability through home ownership requirements; to enhance the quality of the neighborhood through compatible residential densities; and to reinforce neighborhood historical architectural character through the use of compatible building design, modern building materials, and exceptional landscaping.
(1) Those uses or categories of uses as listed herein, and no others, are permitted in the Century Town Homes PRO zone.
(2) All uses listed herein are listed by number as designated in the Standard Land Use Code published and maintained by the Planning Commission. Specific uses are identified by a four (4) digit number in which all digits are whole numbers. Classes or groupings of such uses permitted in the zone are identified by a four (4) digit number in which the last one or two digits are zeros.
(3) All such categories listed herein and all specific uses contained within them in the Standard Land use Code shall be permitted in the Century Town Homes PRO zone, subject to the limitations set forth herein.
(4) Permitted Principal Uses. The following principal uses and structures, and no others, are permitted in the Century Town Homes PRO zone:

(5) Permitted Accessory Uses. Accessory uses and structures are permitted in the Century Town Homes PRO zone, provided they are incidental to and do not substantially alter the character of the permitted principal use or structure. Such permitted accessory uses and structures include, but are not limited to, the following:
(a) Vegetable and flower gardens and noncommercial orchards;
(b) Home occupations subject to the regulations of Chapter 14.41, Provo City Code;
(c) Storage of materials used for construction of a building, including the contractor’s temporary office, provided that such use is on the building site or immediately adjacent thereto, and provided further that such use shall be permitted only during the construction period and thirty (30) days thereafter; and
(d) Household pets, provided that no more than two (2) dogs and two (2) cats six (6) months of age or older shall be kept at any residence at any time. Nothing herein shall be construed as authorizing the keeping of any animal capable of inflicting harm or discomfort or endangering the health and safety of any person or property.
(e) No accessory buildings shall be permitted except gazebos, shelters and other such recreational buildings or structures constructed in designated open space for use by the entire development as determined by a Homeowner’s Association.
(6) Conditional Uses. There are no conditional uses, except as provided in subsection (b) above, in the Century Town Homes PRO zone.
Lot area per dwelling in the Century Town Homes PRO zone shall provide twenty-eight hundred (2,800) square feet of lot area per dwelling unit.
Each dwelling unit in the Century Town Homes PRO zone shall have a building pad in with an average width of not less than twenty (20) feet and an average depth of thirty-two (32) feet.
The minimum finished floor area for a dwelling unit in the Century Town Homes PRO zone shall be one-thousand two-hundred eighty (1,280) square feet, exclusive of garage.
The following minimum yard requirements shall apply in the Century Town Homes PRO zone:
(1) Front Yard. Each lot or parcel in the Century Town Homes PRO zone shall have a front yard of not less than twenty (20) feet.
(2) Side Yard. Except as provided in Subsections (3), (4), and (5) of this section, each lot or parcel of land in the Century Town Homes PRO zone shall have a side yard of at least thirty (30) feet on each side of the lot.
(3) Side Yard, Corner Lots. On corner lots, the side yard contiguous to the street shall not be less than twenty (20) feet in width, and shall not be used for vehicular parking except such portion as is devoted to driveway use for access to a garage or carport.
(4) Side Yard, Driveway. See Section 14.37.100, Provo City Code.
(5) Side Yard, Accessory Building. An accessory building may be located no closer than eight (8) feet from a side property line. An accessory building is not permitted in a street side-yard.
(6) Rear Yard. Each lot or parcel in the Century Town Homes PRO zone shall have a rear yard of not less than eight (8) feet.
(7) Rear Yard, Accessory Buildings. An accessory building may be located no closer than eight (8) feet from a rear property line.
(1) The following structures may be erected on or project into any required yard:
(a) Fences and walls in conformance with the Provo City Code and other City codes and ordinances;
(b) Landscape elements including trees, shrubs, agricultural crops, and other plants;
(c) Necessary appurtenances for utility service.
(2) The structures listed below may project into a minimum front, street side yard or rear yard not more than ten (10) feet, and into a minimum side yard not more than two (2) feet.
(a) Cornices, eaves, belt courses, sills, buttresses, covered open porches, patios, or other similar architectural features;
(b) Fireplace structures and bays, provided they are not wider than eight (8) feet and are generally parallel to the wall of which they are a part;
(c) Stairways, balconies, door stoops, fire escapes, awnings, and planter boxes or masonry planters.
No lot or parcel of land in the Century Town Homes PRO zone shall have a building or structure used for dwelling or public assembly which exceeds a height of thirty-five (35) feet; except as may be permitted by Section 14.34.090, Provo City Code. Chimneys, flagpoles, or similar structures not used for human occupancy are excluded in determining height.
Each lot or parcel in the Century Town Homes PRO zone shall have, on the same lot or parcel, two (2) enclosed automobile parking spaces per residential unit. Additionally, visitor parking shall be provided at the rate of one-half (0.5) parking space per unit. No parking shall be allowed in driveway areas accessing residential units. All parking spaces shall be built as described in Section 14.37.090, Provo City Code, and shall be provided with paved concrete access from a public street. Parking spaces shall not be provided within a required front yard. Paved access for parking spaces shall have a minimum width of sixteen (16) feet for two (2) way traffic. Vehicular backup space from enclosed garages shall have a minimum depth of twenty-six (26) feet. All other parking standards of Chapter 14.37, Provo City Code, shall apply.
(1) Each development in the Century Town Homes PRO zone shall comply with Sections 14.04A.020 (Project Plan), 14.34.280 (Design Review) and 14.34.285 (Residential Design Standards). All structures shall receive approval from the Design Review Committee prior to the issuance of a building permit. The following specific design standards shall apply to all development in Century Town Homes PRO zone.
(2) Building Requirements.
(a) Development design shall include variety of building colors and textures. Building forms and landscape materials shall be harmonious with existing neighborhood dwellings. Architectural character shall be similar to the historic character of dwellings in the Foothills neighborhood. Architectural features should enhance individual identity of each dwelling unit.
(b) Architecture shall harmonize with permanent neighboring development. Diversity of detail and materials among different buildings is encouraged.
(c) Windows, balconies, and porches should be oriented to a public street. Window designs may be varied to reflect the diversity of architecture.
(d) Roof forms shall harmonize with the architectural character of adjacent buildings; including gable, hip, and pyramid.
(e) Building materials should be durable and suitable for the design in which they are used.
(f) Light fixtures shall be provided at each building entry.
(g) Each residential unit shall have an associated private outdoor space, deck or patio.
(1) Signs. Unless otherwise prohibited by law, signs of the type and description listed below, and no others, may be placed and maintained in the Century Town Homes PRO zone:
(a) One (1) sign or name plate not exceeding twenty (20) square feet placed upon a building which identifies the name and/or address of an apartment structure or complex;
(b) One (1) sign or name plate not exceeding two (2) square feet which identifies the name and/or address of the occupant of each one-family dwelling;
(c) Two (2) temporary signs with a maximum area of six (6) square feet each, pertaining to the sale, lease, or rent of the particular building, property, or premises upon which displayed, and no other;
(2) Landscaping. See Section 15.20.080(2)(b), Provo City Code.
(3) Trash Storage. See Section 14.34.080, Provo City Code.
(4) Fencing Standards. See Section 14.34.500, Provo City Code.
(5) In addition to the above requirements all parking and driveway areas shall be screened by a four (4) foot sight obscuring fence located no closer than to the front property line than the front yard set back.

This notice shall be located on a six (6) inch by six (6) inch metal or plastic plate permanently attached to the electrical box with minimum one-half (1/2) inch engraved letters.
(4) Parking shall be limited to two (2) spaces per dwelling unit and each unit shall be limited to not more than two (2) vehicles. No recreational vehicles shall be stored on property outside of an enclosed garage.
