ARTICLE XXII

GENERAL STANDARDS

SECTION 22.01 - GENERAL STANDARDS

The types of uses requiring Board of Appeals or Township Planning Commission approval shall be deemed to be permitted uses in their respective districts, subject to the requirements and general standards set forth in this Article. Each specific use for which a permit is sought should be considered as an individual case and shall conform to the detailed application of the following general standards in a manner appropriate to the particular circumstances of such use.

SECTION 22.02 - ALL USES AS LISTED IN ANY DISTRICT REQUIRING BOARD OF APPEALS OR TOWNSHIP PLANNING COMMISSION APPROVAL FOR A PERMIT

Shall be of such a location, size and character, that in general it will be in harmony with the appropriate and orderly development of the district in which it is situated and will not be detrimental to the orderly development of adjacent districts. The Board of Appeals or Planning Commission shall give consideration to the following:

A.

The location and size of the use and nature and intensity of the operations involved in or conducted in connection with the use requested.

B.

The size, layout and its relation to the pedestrian and vehicular traffic to and from the use and taking into account, among other things, convenient routes of pedestrian traffic, particularly children.

C.

The assembly of persons in connection with the use will not be hazardous to the neighborhood or be incongruous therewith or conflict with the normal traffic of the neighborhood.

D.

Vehicular turning movements shall be considered in relation to the routes of traffic flow, its relation to street intersections, site distance and the general character and intensity of development of the neighborhood.

E.

In commercial or industrial districts, the nature, location, height, size and site layout shall be such that it will be a harmonious part of the district in which it is situated, taking into account, among other things, prevailing shopping habits, convenience of access by prospective patrons, the physical and economic relationship of one type of use to another, and characteristic groupings of uses in a commercial or industrial district.

F.

The site layout, the location, nature and height of walls, fences and the display of signs in connection with the use shall be such that the use will not hinder the appropriate development and use of adjacent land and buildings or impair the value thereof.

G.

The size, location, height, intensity and site layout of the use shall be such that its operations will not be objectionable to nearby dwellings by reasons of noise, fumes, or flash of lights to a greater degree than is normal with respect to the proximity of commercial to residential uses.
