§ 54-30.56

O-1 Office District.

A. 
Permitted principal uses.[1] The O-1 district is designed to permit business offices, professional offices and administrative offices in relatively close proximity to the R-B district, which will contribute to the creation of a town center, and also to permit uses that are compatible and complementary to the R-B district. Those principal uses permitted in the O-1 district are:
(1) 
Business offices, administrative offices and professional offices;
(2) 
Banks;
(3) 
Restaurants; and,
(4) 
Conference centers/hotels containing at least 150 hotel rooms.
B. 
Permitted accessory uses. Accessory uses and structures permitted in the O-1 district are those uses and structures which are customarily incidental and subordinate to a permitted principal use. In case of a question concerning whether a use or structure is accessory to a permitted principal use, the determination thereof shall lie with the Zoning Board of Adjustment.
C. 
Conditional uses. The conditional uses permitted in the O-1 district are indicated in Subsection 54-30.15; provided that such uses shall comply with the conditions for said uses in Subsection 54-30.15.
D. 
Prohibited uses. Any use other than those uses specifically permitted in paragraphs A, B and C above is prohibited. In addition, the following uses are specifically prohibited:
(1) 
Retail or wholesale stores;
(2) 
Industrial operations; and
(3) 
Multifamily dwelling units.
E. 
Required conditions.
(1) 
Minimum lot area. There shall be a minimum lot area of five acres.
(2) 
Minimum front yard. There shall be a front yard setback of at least 100 feet.
(3) 
Minimum side yards. No side yard shall be less than 100 feet.
(4) 
Minimum rear yard. There shall be a rear yard of at least 100 feet.
(5) 
Minimum distance between buildings. There shall be a minimum distance between buildings that is equal to the sum of the heights of the two buildings.
(6) 
Maximum height. No building shall exceed a maximum height of 50 feet; provided, however, accessory roof structures with a maximum height of 17 feet can be placed on the roof if the accessory structures do not exceed 5% of the total roof area.
(7) 
Maximum impervious coverage. The total impervious coverage on any lot shall not exceed 60% of the total lot area; provided that if the lot is also located within the CWR district, the total impervious coverage shall not exceed 45% of the total lot area.
(8) 
Concept plan. Before any land can be subdivided, or before a site plan can be approved for any development in the O-1 district, a comprehensive development plan for the entire tract must be submitted to and reviewed by the Planning Board to see how the proposed use fits into the ultimate development pattern.
