§ 54-21.17

Developer's agreements.

Prior to any construction and coincident with the furnishing of the performance guarantee by the developer, the developer shall enter into a developer's agreement with the Township Council incorporating all of the terms and conditions of approval as required by the Planning Board. No cutting of trees or vegetation, and no excavation, earth moving or installation of infrastructure shall be permitted until the developer's agreement is executed between the Township Council and the developer. No Township official shall sign an approved preliminary subdivision or site plan until the required developer's agreement has been executed.
The developer's agreement shall require a site restoration bond in the amount of $10,000 to be posted as part of preliminary approval. The bond is intended to provide the Township with a cash guarantee prior to the installation of public improvements required pursuant to Subsection 54-21.18. The site restoration bond shall be in cash or certified check made payable to the Township of Rockaway. The bond shall be refunded upon the filing of the performance guarantee required pursuant to subsections 54-15.4 and 54-21.18.
