Sec. 17.1.- Purpose and intent.

The INS Institutional District is intended for the establishment of private institutional uses and public facilities in those areas designated within the INS Institutional land use category on the Future Land Use Map. Such uses may include ancillary commercial and residential uses, such as gift shops and residence halls, which are clearly subordinate to the principle use of the property.

Sec. 17.2. - Permitted principal uses and structures.

(a)

Places of worship with fewer than 100 seats in the main sanctuary.

(b)

Utility substations and/or rights-of-way.

(c)

Public facilities, including public parks and other public recreational uses.

Sec. 17.3. - Allowable conditional uses.

Subject to the provisions or restrictions contained in this section and elsewhere in this Code, allowable conditional uses in the INS Institutional District are as follows:

(a)

Places of worship with 100 seats or more in the main sanctuary.

(b)

Residential structures as an ancillary use to the institution.

(c)

Commercial docks - Classes B and C only.

(d)

Clubs, private and community service.

(e)

Schools, public, private or charter.

(f)

Social service agencies.

Sec. 17.4. - Prohibited uses and structures.

All uses and structures not of a nature specifically or provisionally permitted herein are hereby prohibited in the INS Institutional District.

Any use which has been determined under the provisions of Chapter 46 of the Code of Ordinances to be potentially noxious, dangerous or offensive to residents of the district or to those who pass by on public roadways or likely for other reasons to be incompatible with the character of the district, is hereby prohibited in the INS Institutional District.

Sec. 17.5. - Other standards.

(a)

Performance standards. In order to minimize effects on the surrounding residential area the following standards shall apply:

(1)

All vehicular use areas, play areas, recreation areas, ball fields or similar recreation areas shall be effectively screened from contiguous residential properties.

(2)

The performance standards required by section 6.17 of this Code shall also apply.

(b)

Locational criteria. In keeping with the purpose and intent of this district, it may be appropriate to locate this district in or near residential areas so as to serve the community needs for religious, civic, limited educational or similar limited institutional functions. In reviewing requests to locate this district, the potential impacts of traffic, noise, neighborhood disruption, operational characteristics and similar potentially adverse effects on the surrounding neighborhood shall be considered. Where it is found that the uses permitted by this district may cause these adverse effects and where the restriction and performance standards of the district would not reasonably protect the neighborhood from such effects, this district shall not be approved.

Sec. 17.6. - Minimum zoning lot requirements.

(a)

The minimum lot area and width requirements in the INS Institutional District are as follows:

(1)

Lot area: One acre for a place of worship or school; 25,000 square feet for any other use.

(2)

Lot width: 100 feet.

(b)

Ancillary residential uses shall be limited as follows:

(1)

Notwithstanding the following provisions, any place of worship shall be allowed a minimum of one residential unit, so long as minimum yard requirements can be met. Such a single unit shall not require the approval specified by section 17.3 of this division. Occupancy of such units shall be limited to officials of the associated place of worship.

(2)

Residential density shall be supported by no more than 50 percent of the total land area of the site zoned as INS. This provision shall apply even in the event that the FAR of the principle institutional use requires less than 50 percent of site area.

(3)

Allowable ancillary residential density shall be 12.5 units per acre for places of worship and seven and one-half units per acre for all other uses.

(4)

Structures supporting ancillary residential uses shall be set back at least 50 feet from any residentially zoned property.

Sec. 17.7. - Minimum yard requirements.

Required setbacks shall be as follows:

(1)

Front yard: 25 feet.

(2)

Secondary front yard: 15 feet.

(3)

Side yards: Ten feet or ten percent of the lot width, whichever is greater, to a maximum of 20 feet.

(4)

Rear yard: 15 feet.

Sec. 17.8. - Maximum height of structures.

The maximum height for all structures shall be 30 feet, except for places of worship, which shall be allowed a maximum height of 50 feet. Purely aesthetic architectural features of places of worship, such as steeples, minarets, religious symbols and flag poles shall not count against the building height limits.

Sec. 17.9. - Minimum off-street parking requirements.

Shall be in accordance with the requirements of division 23 of the Land Development Code, Off Street Parking and Loading.

Sec. 17.10. - Landscaping required.

All uses shall be landscaped in accordance with the provisions of division 22 of the Land Development Code.

Sec. 17.11. - Maximum floor area ratio.

Maximum floor area ratio (FAR) for non-residential uses: 0.65.

Sec. 17.12. - Maximum impervious surface ratio.

Maximum impervious surface ratio (ISR): 0.80.
