RFO RESORT FACILITIES OVERLAY DISTRICT

Sec. 21.1.- Purpose and intent.

The RFO Resort Facilities Overlay District is applied to specific residential areas or parts of such areas in the city that have been designated appropriate for a mixture of residential and transient accommodation uses and are designated with the RFO Resort Facilities Overlay on the future land use map and is intended to allow certain types of transient accommodations in addition to the uses permitted in the underlying zoning district.

Sec. 21.2. - Permitted principal uses and structures.

Subject to the provisions or restrictions contained in this section and elsewhere in this Code, permitted uses and structures in areas designated with the RFO Resort Facilities Overlay District are as follows:

(a)

All uses permitted in the underlying zoning district.

Sec. 21.3. - Permitted accessory uses and structures.

(a)

Uses and structures which are customarily accessory and clearly incidental and subordinate to permitted or permissible uses and structures, do not involve the conduct of a business, and are not of a nature prohibited under section 21.5.

Sec. 21.4. - Allowable conditional uses.

Subject to the provisions or restrictions contained in this section and elsewhere in this Code, allowable conditional uses in the RFO Resort Facilities Overlay District are as follows:

(a)

All permitted conditional uses permitted in the underlying zoning district.

(b)

Transient accommodations—Bed and breakfast inns and motels.

Sec. 21.5. - Prohibited uses and structures.

All uses and structures not of a nature specifically or provisionally permitted herein or within the underlying zoning district are hereby prohibited in the RFO Resort Facilities Overlay District.

Any use which has been determined under the provisions of Chapter 46 of the Code of Ordinances to be potentially noxious, dangerous or offensive to residents of the district or to those who pass by on public roadways or likely for other reasons to be incompatible with the character of the district, is hereby prohibited in the RFO Resort Facilities Overlay District.

Sec. 21.6. - Minimum zoning lot requirements.

The maximum residential density permitted in the RFO Resort Facilities Overlay District shall not exceed the maximum number of dwelling units per acre determined by the underlying residential category. Transient Accommodation use shall not exceed a ratio of 1.67 transient accommodation units to the permitted number of the underlying residential units. The minimum lot area and width requirements in the RFO Resort Facilities Overlay District are as follows:

(a)

Detached single-family, two-family and multifamily dwellings.

(1)

Lot area: As required by the underlying district regulations.

(2)

Lot width: As required by the underlying district regulations.

(b)

Transient accommodation uses.

(1)

Lot area: 2,609 square feet for each transient accommodation unit other than bed and breakfast inns which shall be developed in accordance with the requirements of section 6.2.

(2)

Lot width: 50 feet.

(c)

All other uses. The lot area and width requirements stated below shall be considered the minimum standards; however, the requirements may be modified by the city under the site plan review process to fit the specific use.

Lot area: As required by the underlying district regulations.

(2)

Lot width: As required by the underlying district regulations.

Sec. 21.7. - Minimum yard requirements.

The minimum yard requirements for principal structures in the RFO Resort Facilities Overlay District are as required in this section.

(a)

Residential dwellings and transient accommodation uses.

(1)

Front yard: 20 feet.

(2)

Secondary front yard: Ten feet.

(3)

Side yards: Ten percent of the lot width.

(4)

Rear yard: 20 feet.

(5)

A minimum of 30 percent of the net buildable lot shall be maintained as green space.

(b)

All other uses. The yard requirements stated below shall be considered the minimum standards; however, the requirements may be modified by the city under the site plan review process to fit the specific use.

Front yard: As required by the underlying district regulations.

(2)

Secondary front yard: As required by the underlying district regulations.

(3)

Side yards: As required by the underlying district regulations.

(4)

Rear yard: As required by the underlying district regulations.

Sec. 21.8. - Maximum height of structures.

(a)

Residential and transient accommodation structures: As required by the underlying district regulations.

(b)

Other structures: 35 feet.

Sec. 21.9. - Minimum off-street parking requirements.

(a)

Residential. Shall be in accordance with the requirements of division 23 of the Land Development Code, Off Street Parking and Loading.

(b)

Transient accommodations. Shall be in accordance with the requirements of division 23 of the Land Development Code, Off Street Parking and Loading.

(c)

All other uses. As determined necessary under the conditional use approval procedures.

Sec. 21.10. - Landscaping required.

All uses shall be landscaped in accordance with the provisions of division 22 of the Land Development Code.

Sec. 21.11. - Maximum floor area ratio.

Maximum floor area ratio (FAR) for non-residential uses: 0.40.

Sec. 21.12. - Maximum impervious surface ratio.

The lot area used in the calculation of the maximum impervious surface ratio shall exclude any portion of the property lying seaward of the city's coastal construction and excavation setback line.

Maximum impervious surface ratio (ISR) for residential and transient accommodation uses: 0.70

Maximum impervious surface ratio (ISR) for non-residential uses: Underlying district requirements.
