CHAPTER 4000

R-8 RESIDENTIAL MIXED HOUSING DISTRICT

4000.1: PURPOSE:

The R-8 residential mixed housing district is intended to provide a district which allows for a full and complete range and intermixing of residential activities, and to accommodate development in areas which existed prior to the establishment of this ordinance. (Ord. 1988-12, 12-19-1988)

4000.2: PERMITTED USES:

The following are permitted uses within an R-8 district:
All permitted uses in the R-1 through R-7 zoning districts. (Ord. 1988-12, 12-19-1988)

4000.3: ACCESSORY USES:

The following are permitted accessory uses within the R-8 zoning district:
All permitted accessory uses within the R-1 through R-7 zoning districts. (Ord. 1988-12, 12-19-1988)

4000.4: CONDITIONAL USES:

The following are conditional uses in an R-8 district: (Requires a conditional use permit based upon procedures set forth in and regulated by chapter 400 of this ordinance.)
All conditional uses, subject to the same conditions, as allowed in the R-1 through R-7 zoning districts.
Small cell wireless support structures. (Ord. 1988-12, 12-19-1988; amd. Ord. 2019-13, 12-16-2019)

4000.5: LOT REQUIREMENTS AND SETBACKS:

The following minimum requirements shall be observed in an R-8 district, subject to additional requirements, exceptions and modifications set forth in this ordinance:
   A.   Lot area: Twelve thousand five hundred (12,500) square feet.
   B.   Lot width: Ninety feet (90').
   C.   Setbacks:
      1.   Front yard:
         a.   Townhouses: Not less than thirty feet (30').
         b.   Multiple-family dwellings and other housing: Not less than thirty five feet (35').
      2.   Side yard:
         a.   Interior lots:
            (1)   Single-family and two-family dwellings: Not less than ten feet (10'), except a five foot (5') side yard setback is permitted for an attached garage and any living space constructed above the attached garage footprint.
            (2)   All other uses: Not less than ten feet (10') each.
         b.   Corner lots: Not less than twenty feet (20') on the side yard abutting a public street.
      3.   Rear yard:
         a.   Principal buildings: Twenty five feet (25').
         b.   Accessory buildings: Per section 1000.4 of this ordinance. (Ord. 1988-12, 12-19-1988; amd. Ord. 2009-017, 11-2-2009)

4000.6: MAXIMUM BUILDING HEIGHT:

   A.   Principal building: Thirty five feet (35').
   B.   Accessory building: Per section 1000.4 of this ordinance. (Ord. 1988-12, 12-19-1988)

4000.7: MAXIMUM LOT COVERAGE:

No structure or combination of structures shall occupy more than sixty percent (60%) of the lot area. (Ord. 1988-12, 12-19-1988)
