The following are conditional uses in a P/I district: (Requires a conditional use permit based upon procedures set forth in and regulated by chapter 400 of this ordinance.)
Automobile parking lots as a principal use; provided, that:
A. The use and design is in conformance with chapter 1200 of this ordinance.
B. The provisions of subsection 400.2F of this ordinance are considered and satisfactorily met.
Cemeteries or memorial gardens; provided, that:
A. The site is landscaped in accordance with section 1000.7 of this ordinance.
B. The use is available to the public.
C. The land area of the property containing such use or activity meets the minimum established for the district.
D. All cemetery buildings shall meet the minimum district setbacks for principal structures. Columbarium, head stones, grave markers and other accessory cemetery structures shall be setback a minimum of ten feet (10') from all lot lines.
E. The site accesses on a collector or arterial street.
F. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Colleges, seminaries and other institutions of higher education; provided, that:
A. Adequate parking and loading is provided in conformance with chapters 1200 and 1300 of this ordinance.
B. Provisions are made to buffer and screen any surrounding residential uses.
C. The site is served by an arterial or collector street of sufficient capacity to accommodate traffic which will be generated.
D. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Commercial and public radio and television transmitting antennas and public utility microwave antennas, as regulated by chapter 2500 of this ordinance.
Commercial, private and public satellite dish transmitting or receiving antennas in excess of two meters (2m) in diameter, as regulated by chapter 2500 of this ordinance.
Community centers; provided, that:
A. Adequate screening from abutting and adjoining residential uses and landscaping is provided.
B. Adequate off street parking and access is provided and that such parking is adequately screened and landscaped from adjoining and abutting residential uses.
C. Adequate off street loading and service entrances are provided and regulated, where applicable, by chapter 1300 of this ordinance.
D. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Daycare, social services or other nondirectly related worship type activities as an accessory use within a religious institutional building(s); provided, that:
A. Compatibility with surrounding existing and potential uses is maintained.
B. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Governmental and public regulated utility buildings, street garages and structures necessary for the health, safety and general welfare of the community; provided, that:
A. Compatibility with the surrounding neighborhood is maintained and required setbacks and side yard requirements are met.
B. Equipment is completely enclosed in a permanent structure with no outside storage.
C. Adequate screening from neighboring uses and landscaping is provided in compliance with section 1000.7 of this ordinance.
D. The provisions of subsection 400.2F of this ordinance are considered and determined to satisfied.
Hospitals and residential care facilities including extended care facilities for mentally challenged, rest homes and care for the aged, ill and infirm; provided, that:
A. Interior side yards are screened.
B. Only the rear yard shall be used for play or recreational areas. Said area shall be fenced and controlled and screened in compliance with section 1000.7 of this ordinance.
C. The site shall be served by an arterial or collector street of sufficient capacity to accommodate traffic which will be generated.
D. All signing and informational or visual communication devices shall be in compliance with chapter 2000 of this ordinance.
E. All state laws and statutes governing such use are strictly adhered to and all required operating permits are secured.
F. Adequate off street parking is provided in compliance with chapter 1200 of this ordinance.
G. Off street loading space in compliance with chapter 1300 of this ordinance is provided.
H. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Living quarters which are provided as an accessory use to a principal use in section 4850.2 of this chapter or to a conditional use in this section; provided, that:
A. The use shall not be used as commercial rental property.
B. A maximum of one such dwelling shall be allowed.
C. There shall be a demonstrated and documented need for such a facility.
D. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Personal wireless service towers and antennas not located on a public structure, as regulated by chapter 2500 of this ordinance.
Preschool, elementary, junior or senior high schools having a regular course of study accredited by the state of Minnesota.
A. Side yards shall be double that required for the district, but no greater than forty feet (40').
B. Adequate screening from abutting residential uses and landscaping is provided in compliance with section 1000.7 of this ordinance.
C. Adequate off street parking and access is provided on the site or on lots directly abutting or directly across a public street or alley to the principal use in compliance with chapter 1200 of this ordinance and that such parking is adequately screened and landscaped from surrounding and abutting residential uses in compliance with section 1000.7 of this ordinance.
D. Adequate off street loading and service entrances are provided and regulated, where applicable, by chapter 1300 of this ordinance.
E. The provisions of subsection 400.2F of this ordinance are considered and satisfactorily met.
Public or semipublic recreational buildings and/or facilities, other than municipal; provided, that:
A. The site is landscaped.
B. The use is available to the public.
C. The land area of the property containing such use or activity meets the minimum established for the district.
D. The use meets the minimum setback requirements for principal structures.
E. The site accesses on a minor arterial.
F. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Retail commercial activities and personal services; provided, that:
A. Merchandise is sold at retail.
B. Personal services are limited to those uses and activities which are allowed as a permitted or accessory use within a B-2 zoning district.
C. The retail activity and personal services are located within a structure whose principal use is not commercial sales.
D. The retail activity and personal services shall not occupy more than fifteen percent (15%) of the gross floor area of the building.
E. The retail activity and personal services are not located within a structure whose principal use is residential.
F. No directly or indirectly illuminated sign or sign in excess of ten (10) square feet identifying the name of the business shall be visible from the outside of the building.
G. No signs or posters of any type advertising products for sale or services shall be visible from the outside of the building.
H. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
The lot area requirement for permitted uses may be reduced; provided, that:
A. Compatibility with surrounding existing and potential uses is maintained.
B. The provisions of subsection 400.2F of this ordinance are considered and determined to be satisfied.
Other uses of the same general character as those listed in this section and section 4850.2 of this chapter; provided, that:
A. Compatibility with surrounding existing and potential uses is maintained.
