CHAPTER 16

84 - ZONING—CONDITIONAL USES

16.84.010 - Purpose.

Whereas the necessity for certain specific uses is recognized and at the same time appreciating the fact that they or any one of them may be, or become inimical to the public health, safety and general welfare of the township, if located without due consideration to the existing conditions and surroundings, the following standards and procedures are hereby established.

These standards are intended to provide the planning board with a guide for the purpose of reviewing certain uses not otherwise permitted, except under restrictions of this chapter in approving a site plan, the planning board may act on site plans submitted to it or may suggest modifications and changes. Such change and modifications, as well as original provisions of the site plans which have not been modified shall be maintained as a condition of the establishment and maintenance of any use to which they are appurtenant.

16.84.020 - Churches.

Churches may be permitted where specified as a conditional use provided they meet the following standards:

A.

A set of plans, specifications and plot plans shall be filed with the planning board, showing overall dimensions, topographic conditions, the location and intended use of existing and proposed buildings, the relationship of the proposed use to streets and adjacent properties and other physical features which might act as a deterrent to the general welfare.

B.

Before issuing a permit, the planning board shall determine that the following standards are met:

1.

The minimum lot area shall be two acres and the minimum frontage shall be two hundred (200) feet.

2.

Off-street parking shall be provided at the ratio of one off-street parking space for each four seats in the church.

3.

Driveways shall cross the sidewalk at right angles, and shall be no more than twenty-four (24) feet wide at any point. Driveways must be at least ten (10) feet from any side lot line and fifty (50) feet from the intersection of street lines. No more than two driveways shall be permitted for each two hundred (200) feet of street frontage.

4.

The planning board shall determine that the site plan is appropriate to the adjacent area. It may require buffers if necessary to protect surrounding properties from the effect of light or noise generated in connection with use of the property.

16.84.030 - Schools.

Nursery, elementary, secondary and intermediate schools, but not trade or business schools, giving regular instruction at least five days a week for eight or more months of the year may be permitted where specified as a conditional use, provided they meet the following standards:

A.

Application for a permit shall be made to the planning board. The application shall include:

1.

A detailed plot plan of the site, drawn to scale, indicating overall dimensions, topographical conditions, the location and intended use of existing and proposed buildings, the relationship of the proposed use to highways, streets and adjacent properties, and such physical features as might present any deterrent to the protection of the health and safety of the pupils;

2.

A set of preliminary architectural plans and general specifications of existing and proposed buildings and structures and a statement setting forth in general terms the proposed course of instruction. This statement shall indicate the grade levels of the pupils to be housed in the building or buildings, the planned pupil capacity of such school or buildings and the contemplated eventual enrollment of the school.

B.

Before issuing a permit, the planning board shall determine that the following standards are met:

1.

The curriculum of the proposed school shall be approved by the New Jersey Department of Education. The minimum lot area for a nursery school shall be one acre.

2.

The minimum lot area for a nursery school shall be one acre, plus an additional acre for each four hundred (400) pupils. The minimum lot area for an elementary school shall be ten (10) acres, plus one additional acre for each four hundred (400) pupils. The minimum lot area for an intermediate school shall be twenty (20) acres, plus one additional acre for each one hundred (100) pupils. The minimum lot area for a high school shall be thirty (30) acres, plus one additional acre for each one hundred (100) pupils. No more than thirty-five (35) percent of the site shall be covered by buildings.

3.

Adequate provisions shall be made for the safe pick-up and discharge of students.

4.

The principal building minimum shall be:

Front yard 50 ft. 100 ft.

5.

Adequate provisions shall be made for the safe pick-up and discharge of students. No reverse drive of vehicles shall be permitted.

6.

No parking shall be allowed within twenty-five (25) feet of any street or property line. No organized play shall be allowed within one hundred (100) feet of any street or property line. No buildings shall be allowed within fifty (50) feet of any street or property line.

7.

Parking shall be in accordance with Chapter 16.22.

16.84.040 - Limited industry.

A.

Limited Industry Uses. Limited industry uses, including the following, may be permitted in the interstate business II zone, provided the conditions set forth in subsection B of this section are met:

1.

Offices;

2.

Industrial plants of a type which carry on processes within completely enclosed buildings, including:

a.

The manufacture, assembly or treatment of articles or merchandise for previously prepared materials.

b.

Manufacture of toys, novelties, rubber or metal stamps and other molded products;

c.

Manufacture or assembly of electrical appliances, electronic instruments and component parts, radios and phonographs;

3.

Wholesale distribution centers and warehouses;

4.

Laboratories of an experimental research or testing nature;

5.

Retail sales of the products manufactured as the principal use.

B.

Conditions.

1.

A set of plans, specifications and a survey shall be filed with the planning board showing overall dimensions, topographic conditions, the location and intended use of existing and proposed buildings, the relationship of the proposed use to streets and adjacent properties as well as other physical features that might act as a deterrent to the general welfare.

2.

The following minimum standards shall be complied with before issuance of a permit:

a.

The minimum lot area shall be one acre.

b.

The lot shall have frontage on an improved township street of not less than two hundred (200) feet at the property line.

3.

The planning board shall determine that the site plan is appropriate to the area. Buffers, in accordance with Chapter 16.28, may be required.

4.

Parking shall be in accordance with Chapter 16.22.

16.84.050 - Motor vehicle and truck service and fueling stations.

Motor vehicle and truck service and fueling stations may be permitted in the interstate business II zone, provided that the following standards are met:

A.

A set of plans, specifications and plot plan filed with the planning board showing in detail the exact location of the motor vehicle service station, the exact number and location of fuel tanks to be installed, the dimensions and capacity of each fuel tank, the number and location of pumps to be installed, the type of structure and accessory buildings to be constructed and any other information the planning board may deem necessary.

B.

The following minimum standards shall be complied with before issuance of a permit:

1.

The minimum lot area shall be one acre.

2.

The lot shall have frontage on an improved township street of not less than one hundred (100) feet.

C.

All fuel pumps shall be located at least twenty-five (25) feet from any property line or street.

D.

The planning board shall determine that the site plan is appropriate to the area. Buffers, in accordance with Chapter 16.28, may be required.

16.84.060 - Tractor and trailer parking.

Tractor and trailer truck parking may be permitted in the interstate business II zone as a conditional use, provided they meet the following standards.

A.

Temporary parking no longer than ten (10) consecutive days.

B.

Parked trailers are to be empty.

C.

No overnight sleeping shall be permitted.

D.

Parking area to be secured.

E.

All parking space shall have designated spaces.

F.

Refrigeration trucks and trailers not permitted to be running while on-site.

G.

Parking areas shall have management office/shelter on-site for management during operating hours, minimum of two thousand five hundred (2,500) square feet.

H.

The site shall have direct access to a municipal, county or state arterial roadway.

I.

Provisions for electric charging facilities to be considered or otherwise as required by municipal ordinance or New Jersey state law.
