§ 108-28.2

Event structures.

Rural event venues may utilize event structures, including, but not limited to, barns, as defined in § 108-2.2 of this Zoning chapter, provided the following criteria are satisfied:
A. 
The use of an event structure shall be permitted only after issuance of a building permit and a certificate of occupancy for public assembly by the Town's Code Enforcement Officer.
B. 
The applicant shall provide the Code Enforcement Officer and Zoning Administrator with a plan prepared by a registered licensed design professional to improve the event structure to enable it to obtain a certificate of occupancy for an assembly area, where none exists. A copy of the plan shall also be submitted to the Planning Board as part of site plan review.
C. 
The occupancy of the event structure shall not exceed occupancy load and exiting provisions of the New York State Uniform Code and those occupancy load limits shall be posted at the premises by the Town's Code Enforcement Officer. Nothing shall be interpreted to allow more than 300 attendees as part of a rural event venue.
