PLANNED RESIDENTIAL DISTRICT

§ 1 PLANNED RESIDENTIAL DISTRICT.

The regulations set forth in this section or elsewhere in this Ordinance when referred to in this section are the regulations in the Planned Residential District.

§ 2 USE REGULATION.

The Planned Residential District is designed to accommodate various types of unique and innovative housing forms which are usually based upon a concept of reducing the area of individually owned lots and grouping such lots together to more efficiently utilize the total space within the subdivision by creating common open spaces, scenic and recreational areas and other open spaces which would compensate for the reduction of land area contained within the individually owned lot, the following standards have been developed and applied to a variety of such housing forms including, but not limited to townhouses, townhomes, patio homes, courtyard homes, and cluster homes.

§ 3 HEIGHT AND AREA REGULATIONS.

The height and area requirements set forth in Sections XXII and [sic] shall not apply in this district.
a. 
The maximum height of buildings in a Planned Residential District shall be thirty-five (35) feet, and no building shall exceed two stories above ground elevation.
b. 
Density of development shall not exceed twelve (12) dwelling units per gross acre including the common area and public facilities, excluding street right-of-way. The Planning and Zoning Commission and City Council may require less density in certain areas or neighborhoods.

§ 4 PARKING REGULATIONS.

A minimum of two and one-half (2-1/2) off-street parking spaces per family shall be provided on the property in this district. Off-street parking, loading spaces and driveway standards shall be provided in accordance with the provisions of Section XXIII.

§ 5 FIREWALLS.

Where buildings are built to or less than seven and one-half (7-1/2) feet from the property line of platted lots, firewalls shall be constructed according to the requirements of the applicable Building Code, statute or ordinance.

§ 6 SITE PLANS & COVENANTS.

Each applicant hereunder shall submit to the Planning and Zoning Commission and the City Council, in addition to other matters required by all applicable statutes, rules and ordinances, the following:
a. 
A complete preliminary Site Development Plan, prepared by a competent professional, for the development of the tract covered by the application hereunder, clearly showing the improvements, uses, and necessary dimensions.
b. 
An instrument containing restrictions, covenants, and conditions applicable to the ownership, use, control, maintenance, replacement, repair and disposition of the property and improvements covered by such application, which instrument shall, to the satisfaction of the Governing Body of the City of Pittsburg, be sufficient in every respect to insure its compliance by each owner of property thereby, and to insure the realization of the purposes of this Ordinance.
c. 
No application for amendment to the Zoning Ordinance under this section shall ever be recommended or approved without concurrent approval of said Preliminary Site Development Plan and instrument of restrictions, covenants, and conditions by the Council or Body recommending or approving said amendment.

§ 7 DEVIATION FROM APPROVED SITE PLANS.

In the construction upon or use of property as a Planned Residential Unit under this section, there shall be no material deviation from the Preliminary Site Development Plan approved by the Governing Body of the City of Pittsburg without prior approval of said Governing Body. Applications for deviation from approved Preliminary Site Development Plans shall be governed by the statutes, ordinances, and rules applicable to applications for amendments to the text or District Map of the Zoning Ordinance of the City of Pittsburg.

§ 8 ADDITIONAL REQUIREMENTS.

Reasonable additional requirements as to building setback, landscaping, lighting, screening, accessways, driveways, ownership of interest in the unplatted area in the proposed unit, and other reasonable requirements may be imposed by the Planning & Zoning Commission and/or Governing Body of the City of Pittsburg for the protection of the adjoining and surrounding properties.
