SECTION XX

M-2 HEAVY INDUSTRIAL DISTRICT

§ 1 M-2 HEAVY INDUSTRIAL DISTRICT.

The regulations set forth in this Section or set forth elsewhere in this Ordinance when referred to in this Section are the regulations in the M-2 Heavy Industrial District.

§ 2 USE REGULATIONS.

A building or premises shall be used only for the following purposes:
a. 
Any use permitted in the M-1 Light Industrial District except that no dwelling other than that for a resident watchman or caretaker employed on the premises shall be permitted.
b. 
Any other use, other than those enumerated in subparagraph (9) [sic] of the paragraph, not in conflict with any Texas statute or ordinance of the City of Pittsburg regulating nuisances, air quality, water quality, noise, odorous matter, fire and explosive hazard material, toxic and noxious matter, vibration and glare, including the manufacture, compounding, processing, packaging, or treatment of the following products:
i. 
Chemicals, Petroleum, Coal and Allied Products:
a) 
Adhesives.
b) 
Alcohol, industrial.
c) 
Bleaching.
d) 
Bluing.
e) 
Calcimine.
f) 
Candles.
g) 
Cleaning and polishing preparation (non-soap) dressing and blackings.
h) 
Dye-stuff.
i) 
Essential oils.
j) 
Exterminating agents and poisons.
k) 
Fertilizer (non-organic).
l) 
Fuel briquettes.
m) 
Glue and size (vegetable).
n) 
Ink manufacture from primary raw materials (including colors and pigments).
o) 
Soap and soap products.
ii. 
Clay, Stone and Glass Products:
a) 
Abrasive wheels, stones, paper, cloth and related products.
b) 
Asbestos products.
c) 
Brick, fire brick, and clay products.
d) 
Concrete products or central mixing and proportioning plant.
e) 
Glass and glass products.
f) 
Graphite and graphite products.
g) 
Monument and architectural stone.
h) 
Pottery and porcelain products (coal fired).
i) 
Refractories (other than coal fired).
j) 
Sand-lime products.
k) 
Stone products.
l) 
Wallboard and plaster, building insulation and composition flooring.
iii. 
Food and Beverage Products:
a) 
Casein.
b) 
Chocolate and cocoa manufacturing.

Cider and vinegar.

Flour, feed and grain milling.

Gelatin manufacture.

Glucose or dextrose manufacture.

Malt products manufacture.
h) 
Molasses.
i) 
Oil, shortenings, and fats (including oleomargarine).

Pickles, vegetable relish and sauces.
iv. 
Metals:
a) 
Stove and range manufacture.
b) 
Structural iron and steel fabrication and manufacture.
c) 
Tool, die, gauge and machine shops.
d) 
Trailers.
e) 
Wire rope and cable.
v. 
Textiles, Fibers and Bedding:
a) 
Bedding (mattress, pillow and quilt).
b) 
Bleachery.
c) 
Carpets, rugs and mats.
d) 
Cordage and rope.
e) 
Cotton ginning.
f) 
Cotton wadding and linter.
g) 
Hair and felt products washing, curing, dyeing.
h) 
Hosiery mill.
i) 
Jute, hemp and sisal products.
j) 
Linoleum and other hard-surfaced floor covering.
k) 
Nylon.
l) 
Oilcloth, oil-treated products and artificial leather.
m) 
Rayon.
n) 
Shoddy.
vi. 
Wood and Paper Products:
a) 
Barrels.
b) 
Box and crate manufacture.
c) 
Carriages and wagons.

Cooperage works.

Excelsior.

Paper and paperboard products.

Planing and millwork.
i) 
Pulp goods, pressed or molded (including paper-mache products).

Sawmill (including cooperage stock mill).

Wood preserving treatment.

Wood pulling or scouring.
vii. 
Miscellaneous Industries:
a) 
Chewing tobacco manufacture.
b) 
Leather tanning and curing.
c) 
Rubber (natural and synthetic), gutta-percha, chicle and balata processing.
d) 
Rubber tire and tube.
e) 
Shell grinding.
f) 
Storage battery (wet cell).
g) 
Vape/E-Cigarette Retail Shops - Limited to within 1,000 feet of another Vape/E-Cigarette Retail Shop location.
viii. 
Other Uses:
a) 
Automobile wrecking, cars and parts, storage and sale.
b) 
Junk salvage and recycling (metal, paper, rags, waste or glass) storage, treatment, bailing [baling] if within a completely enclosed building or within an area enclosed on all sides with a solid wall or uniformly painted board fence, not less than six feet in height. In no instance shall contents of the facility be visible from outside of the facility and in no instance shall the screen fencing be over 12' in height.
c) 
Oils, vegetable and animal (non-edible) and storage.
d) 
Paint, lacquer, shellac and varnish (including colors and pigments, thinners and removers).
e) 
Railroad yard, roundhouse, repair and overhaul shops.
f) 
Roofing materials, building paper, and felt (including asphalt and composition)
g) 
Salt tanning materials and allied products.
h) 
Tar products (except distillation).
i) 
Vehicle storage facility.
ix. 
Any of the following uses when the location of such use has been approved by the City Council after public hearing and investigation and report by the Planning and Zoning Commission:
a) 
Acid manufacture.
b) 
Cement, lime, gypsum or plaster of Paris manufacture.
c) 
Distillation, manufacture or refining of bones, coal or tar asphalt.
d) 
Explosives, manufacture or storage.
e) 
Fat, grease, lard or tallow rendering or refining.
f) 
Fertilizer manufacture (from organic matter).
g) 
Glue or size manufacture.
h) 
Garbage, offal or dead animal reduction or dumping.
i) 
Paper or pulpwood manufacture.
j) 
Petroleum or asphalt refining.
k) 
Petroleum products terminal.
l) 
Smelting of tin, copper, zinc or iron ores.
m) 
Storage or processing, raw hides or fur.
n) 
Stockyards or slaughter of animals and poultry.

§ 3 HEIGHT AND AREA REGULATIONS.

The following height and area regulations shall be observed. See also Section XXII - HEIGHT AND AREA EXCEPTIONS AND MODIFICATIONS.

§ 4 PARKING AND LOADING REGULATIONS.

Off-street parking and loading spaces shall be provided in accordance with the requirements for specific uses set forth in Section XXIII.

§ 5 NOISE REQUIREMENTS.

The making of noise which exceeds 95 decibels during the daytime (7:00 a.m.–10:00 p.m.) or 85 decibels during the nighttime (10:00 p.m.–7:00 a.m.) measured (at this site) on the industrial zoned property as defined by the Zoning Ordinance of the City of Pittsburg, Texas will be in violation of the City of Pittsburg Noise Ordinance.
The exterior noise level generated by any industrial operations within a protected industrial zone (M-1 Light Industrial or M-2 Heavy Industrial) shall not exceed the allowed noise level requirements by more than five decibels for daytime operations and three decibels for nighttime operations when measured at the nearest boundary of a property occupied by a protected use or 100 feet from the nearest structure occupied by a protected use (as measured to the closest exterior point of the structure), whichever is closer to the protected use.
The exterior noise level generated by industrial operations within a protected industrial zone site or an operation [sic] If a nuisance complaint is received by either the operator or the city from the occupants of any protected use on property located more than 100 feet from the industrial zone, the operator shall, if required by the city, and within 24 hours of notice of the complaint, continuously monitor the exterior noise level generated by operations for a 72-hour period to ensure compliance. At the request of the city, the operator shall monitor the exterior noise level at the source of the complaint.
If the allowed use and operations located within the Industrial Zone, M-2 Heavy Industrial or M-1 Light Industrial, exceed 85 decibels when measured on a property that is within a protected zone listed in the City of Pittsburg Zoning Ordinance then a sound wall, screening or other alternative method will be required to deflect the noise. All soundproofing shall be subject to approval by the city.
