SECTION XIX

M-1 LIGHT INDUSTRIAL DISTRICT

§ 1 M-1 LIGHT INDUSTRIAL DISTRICT.

THE REGULATIONS SET FORTH IN THIS SECTION OR SET FORTH ELSEWHERE IN THIS ORDINANCE WHEN REFERRED TO IN THIS SECTION ARE THE REGULATIONS IN THE M-1 LIGHT INDUSTRIAL DISTRICT.

§ 2 USE REGULATIONS.

A building or premises shall be used only for the following purposes:
a. 
Any use permitted in the B-3 Central Business District.
b. 
The following usages are allowed; however, the storage of parts or inventory (not display for sale) or service areas must not be in permanent view from the road. Such permitted uses being generally service industries and light industries that manufacture, process, store, and distribute goods and materials and are in general dependent on raw materials refined elsewhere, and manufacture, compounding, processing, packaging, or treatment as specified of the following products or similar products:
i. 
Chemical and Allied Products:
a) 
Cosmetics and toiletries (compounding only) ink manufacture (mixing only)
b) 
Insecticides, fungicides, disinfectants, and related industrial and household chemical compounds (blending only)
c) 
Perfumes and scented soap (compounding only) Pharmaceutical products
d) 
Soap, washing or cleaning, powder, or soda (compounding only)
ii. 
Food and Beverage Products:
a) 
Chewing gum manufacture
b) 
Chocolate, cocoa and cocoa products, processing, and packaging only
c) 
Coffee, tea and spices, processing and packaging only
d) 
Condensed and evaporated milk processing and canning only
e) 
Flour, feed, and grain (packaging, blending, and storage only)
f) 
Fruit and vegetable processing (including canning, preserving, drying, and freezing)
g) 
Gelatin products
h) 
Glucose and dextrin products
i) 
Meat products, packing, and processing (no slaughtering)
j) 
Oleomargarine (compounding and packaging only)
k) 
Poultry packing (no slaughtering)
iii. 
Metals and Metal Products:
a) 
Automobile, truck, trailer, motorcycle, and bicycle assembly
b) 
Boat manufacture (vessels less than five tons)

Container manufacturing and sales (metal)

Foundry products manufacture (electrical only)

Iron (ornamental) fabrication

Plating, electrolytic process

Textiles, Bedding, and Fibers:

Knitting, weaving, printing, finishing of textiles and fibers into fabric goods or apparel.

Rubber and synthetic treated fabrics (excluding all rubber and synthetic processing)

Yarns, threads, and cordage
v. 
Wood and Paper Products:
a) 
Basket and pallet (wood, reed, rattan, etc.)
b) 
Modular Home Manufacturing
c) 
Pencil manufacture
d) 
Shipping container (corrugated board, fiber, or wire bound)
e) 
Truss Shop
f) 
Veneer manufacture
g) 
Window and door manufacture
h) 
Woodworking shop
vi. 
Unclassified Uses:
a) 
Animal pound
b) 
Animal, poultry and bird raising, commercial
c) 
Building materials (cement, lime, sand, gravel, lumber, and the like) storage and sales
d) 
Bulk storage of petroleum products for local distribution as distinguished from petroleum products terminal for extensive storage and regional distributing purposes
e) 
Cigarette manufacture
f) 
Coal and coke storage and sales
g) 
Contractor’s shop and storage yard
h) 
Industrial vocational training school, including internal combustion engines
i) 
Leather goods manufacture but not including tanning operations
j) 
Laydown yards (excluding lumber yards)
k) 
Mini or convenience warehouses contained storage or open storage
l) 
Motion picture production
m) 
Portable storage buildings and container manufacturing and sales
n) 
Wholesale storage and sales of building materials

§ 3 HEIGHT AND AREA REGULATIONS.

The following height and area regulations shall be observed. See also Section XXII - Height and Area Exceptions and Modifications.

§ 4 PARKING AND LOADING REGULATIONS.

Off-street parking and loading spaces shall be provided in accordance with the requirements for specific uses set forth in Section XXIII.

§ 5 NOISE REQUIREMENTS.

a. 
The making of noise which exceeds 95 decibels during the daytime (7:00 a.m. - 10:00 p.m.) or 85 decibels during the nighttime (10:00 p.m. - 7:00 a.m.) measured (at this site) on the industrial zoned property as defined by the Zoning Ordinance of the City of Pittsburg, Texas will be in violation of the City of Pittsburg Noise Ordinance.
b. 
The exterior noise level generated by any industrial operations within a protected industrial zone (M-1 Light Industrial or M-2 Heavy Industrial) shall not exceed the allowed noise level requirements by more than five decibels for daytime operations and three decibels for nighttime operations when measured at the nearest boundary of a property occupied by a protected use or 100 feet from the nearest structure occupied by a protected use (as measured to the closest exterior point of the structure), whichever is closer to the protected use.
c. 
The exterior noise level generated by industrial operations within a protected industrial zone site or an operation [sic] If a nuisance complaint is received by either the operator or the city from the occupants of any protected use on property located more than 100 feet from the industrial zone, the operator shall, if required by the city, and within 24 hours of notice of the complaint, continuously monitor the exterior noise level generated by operations for a 72-hour period to ensure compliance. At the city’s request, the operator shall monitor the external noise level at the source of the complaint.
d. 
If the allowed use and operations located within the Industrial Zone, M-2 Heavy Industrial or M-1 Light Industrial, exceed 85 decibels when measured on a property that is within a protected zone listed in the City of Pittsburg Zoning Ordinance, then a sound wall, screening, or another alternative method will be required to deflect the noise. All soundproofing shall be subject to approval by the city.
