SECTION XXVIII

NONCONFORMING USES

§ 1 NONCONFORMING USES.

The use of land for outdoor storage purposes which does not conform to the provisions of this Ordinance shall be discontinued within one year from the effective date of the Zoning Ordinance and provided, further, that the use of land which becomes nonconforming for such use or any other by reason of a subsequent change in this Ordinance shall also be discontinued within one year from the date of the change.

§ 2 CONTINUATION.

The lawful use of a building existing at the time of the effective date of the Zoning Ordinance may be continued although such use does not conform to the provisions thereof.

§ 3 DISCONTINUATION.

In the event that a nonconforming use of any building or premises is discontinued for a period of 6 months, the use of the same shall thereafter conform to the use regulations of the district.

§ 4 EXTENSION.

No nonconforming use, except when required to do so by law or ordinance, shall be enlarged, extended, reconstructed, or structurally altered, unless such use is changed to a use permitted in the district.

§ 5 DAMAGE.

When a building, the use of which does not conform to the provisions of the Zoning Ordinance, is damaged by fire, explosions, act of God, or the public enemy, to the extent of more than 50 percent of its assessed value as listed on the records of the Camp County Appraisal District, it shall not be restored except in conformity with the regulations of the district in which it is located or as provided in Article [Section] XXVIII of the Zoning Ordinance. When damaged by less than 50 percent of its assessed value, a nonconforming building may be repaired or reconstructed and used as before the time of damage, provided such repairs or reconstruction are completed within one year of the date of such damage.

§ 6 NON-VALIDATION.

A use illegally established in violation of the provisions of the Zoning Ordinance which this Ordinance supersedes shall not be validated by the adoption of this Ordinance.
