SECTION XXXIII

AMENDMENTS

§ 1 AMENDMENTS.

The City Council of Pittsburg may, from time to time, amend, supplement, or change by ordinance the boundaries of districts or regulations herein established, or the Planning & Zoning Commission may on its own motion or on request from the City Council institute study and proposal for changes and amendments in the public interest. Any proposed amendments, supplements, or changes instituted by the City Council shall first be submitted to the City Planning & Zoning Commission for its recommendation and report.

§ 2 PETITION.

A property owner, lessee, developer, option holder or authorized agent may petition the City Council for an amendment to the text or District Map of this Ordinance, provided that before any action shall be taken as provided in this Section, an application requesting amendment shall be filed accompanied by a survey of the tract requested to be changed, the party or parties petitioning for amendment shall deposit with the City of Pittsburg a sum of money to cover the approximate cost of this procedure, and under no condition shall said sum or any part thereof be refunded for failure of such proposed amendment to be enacted into law. The sum of money to be deposited is determined by the Zoning Fee Ordinance of the City of Pittsburg.

§ 3 REPORTS.

The Planning Commission shall make a preliminary report and hold public hearings on that report before submitting a final report to the City Council. The City Council may not take action on the matter until it receives the final report of the Planning Commission.
Notices:
Planning Commission Notices: Before the 10th day before the hearing date, written notice of the public hearing before the Planning Commission on a proposed change in a zoning classification shall be sent to each owner as indicated by the most recent approved municipal tax roll, of real property within 200 feet of the property on which the change in classification is proposed. The notice may be served by its deposit in the municipality, properly addressed with postage paid in the United States mail.
City Council Notices: Before the 15th day before the date of the City Council hearing, notice of the time and place of the hearing must be published in an official newspaper or a newspaper of general circulation in the municipality.

§ 4 CHANGES.

If a proposed change to a regulation or boundary is protested in accordance with this subsection, the proposed change must receive, in order to take effect, the affirmative vote of at least three-fourths of all members of the governing body. The protest must be written and signed by the owners of at least 20 percent of either:
(a) 
the area of the lots or land covered by the proposed change; or
(b) 
the area of the lots or land immediately adjoining the area covered by the proposed change and extending 200 feet from that area.

§ 5 AREA.

In computing the area under protest, the area of streets and alleys shall be included.

§ 6 REAPPLICATION.

In the event that:
1. 
the City Council fails to pass an ordinance approving such amendment, supplement or change, or
2. 
the application for a proposed amendment, supplement or change is withdrawn, then in any of these events, a new application for such proposed amendment, supplement, or change in the Zoning Ordinance shall not again be considered until after the expiration of six (6) months from the date such proposed amendment, supplement or change was disapproved or withdrawn. The procedures for such application for rezoning shall be the same as if the applicant has never filed a previous application for amendment, supplement or change.
