SECTION VII

R-TH TOWNHOUSE DISTRICT

§ 1 R-TH TOWNHOUSE DISTRICT.

The regulations set forth in this Section or set forth elsewhere in this Ordinance when referred to in this Section, are the regulations in the R-TH Townhouse District.

§ 2 USE REGULATIONS.

A building or premises shall be used only for the following purposes:
a. 
Attached single-family dwellings (townhomes)
b. 
Any use permitted in the R-2, Two-Family Residential District.
c. 
Any use permitted in the R-1a, One-Family Residential District.

§ 3 HEIGHT AND AREA REGULATIONS.

The following height and area regulations shall be observed. See also Section XXII - HEIGHT AND AREA EXCEPTIONS AND MODIFICATIONS.

*A minimum side yard setback of twelve (12) feet shall be required on corner lots and a minimum side yard setback of 7-1/2 feet shall be required on all end units.
**Garages or carports entered from an alley shall not be located less than 25 feet from the closest edge of the alley.

§ 4 PARKING REGULATIONS.

There shall be provided at the time any building or structure is erected or structurally altered a minimum of two (2) off-street parking spaces per dwelling unit. In addition, there shall be a minimum of one (1) parking space per 100 square feet of floor area for private recreational buildings held in common. Off-street parking, loading spaces and driveway standards shall be provided in accordance with the provisions of Section XXIII.

§ 5 NUMBER OF UNITS.

Not more than six (6) townhouse units shall be contiguous.

§ 6 ARRANGEMENT.

There shall be no more than six (6) townhouse units built in a row with the same, or approximately the same front line in any townhouse project.

§ 7 LOT AREA REGULATIONS.

Each townhouse unit shall be located on an individual lot. At least 50% of the townhouse lots in a project shall be at least 20 feet in width, provided that the remaining lots be at least 16 feet in width. Each lot 20 feet or more in width shall contain not less than 1,800 square feet, and each lot less than 20 feet in width shall contain not less than 1,440 square feet.

§ 8 SEPARATION REQUIREMENTS.

No Portion of a townhouse or accessory structure in or related to one group of contiguous townhouses shall be nearer than fifteen (15) feet to any portion of a townhouse or accessory structure of another group.

§ 9 LAND USE INTENSITY.

The total ground floor area of the townhouse group(s) shall not exceed 40% of the total project area (excluding right-of-way[,] alleys, etc.). For purposes of this Section, ground floor area is the area containing the ground floor of a townhouse and enclosed garage exclusive of accessory buildings and structures.

§ 10 OPEN SPACE.

Private open space shall be provided for all townhouse developments and shall not be less than 100 square feet per dwelling unit. Private open space shall be separate and apart from the area contained in private yards. Private open space shall not be required for townhouse developments of less than one acre unless there exists adjacent property under the same ownership which is zoned “R-TH” and the total area of the property under development and the adjacent property exceeds one acre. For purposes of this section, private open space shall be defined as land area which is devoted to leisure or recreational purposes and facilities, but not for vehicular use.

§ 11 PRIVATE YARD.

Each lot shall contain a private yard with not less than 400 square feet of area. Private yards may contain a patio cover or similar structure which does not cover more than 25% of the area of the private yard.

§ 12 COMMON OPEN SPACE.

A homeowners’ association will be required for improving, operating, and maintaining all jointly owned open spaces, recreational area and buildings, service and parking areas. The instrument creating the homeowners’ association will be reviewed and approved by the City Council to insure that it contains adequate restrictions, covenants and conditions governing the maintenance and operation of all jointly owned open spaces.
