SECTION IV

R-1a ONE-FAMILY RESIDENTIAL DISTRICT

§ 1 R-1a ONE-FAMILY RESIDENTIAL DISTRICT.

The regulations set forth in this Section or set forth elsewhere in this Ordinance, when referred to in this Section, are the regulations in the R-la One-Family Residential District.

§ 2 USE REGULATIONS.

A building or premises shall be used only for the following purposes:
a. 
One-family dwelling with a minimum dwelling size of 700 square feet. It must have a permanent foundation, such as a slab or pier/beam. Structures with chassis, wheels, or axles are prohibited.
b. 
Agricultural uses primarily for home consumption, such as domestic gardening; berry or bush crops, tree crops, flower gardening, nurseries, orchards, aviaries and apiaries, including a greenhouse but not including an office or salesroom or roadside stand.
c. 
Publicly owned or operated park, playground or community building, museum, and library or art gallery.
d. 
Church, temple, synagogue or other place of worship or Sunday school.
e. 
Public school, elementary and high schools, and educational institutions with a curriculum the same as ordinarily given in public schools.
f. 
Golf club or grounds. A miniature course or practice driving tee operated for commercial purposes is permitted.
g. 
Home occupation.
h. 
Subject to the provisions of Section XXII, accessory building or use, including a private garage customarily incident to the above uses but not involving the conduct of a business.

§ 3 HEIGHT AND AREA REGULATIONS.

The following height and area regulations shall be observed. See also Section XXII - HEIGHT AND AREA EXCEPTIONS AND MODIFICATIONS. City staff can approve minimum lot requirement variances of up to 500 square feet if setbacks and other requirements are met.

§ 4 SETBACKS.

Setbacks are determined from the property lines illustrated in the property survey and field notes. The survey must be conducted by a Texas-licensed surveyor. Setbacks are not determined and measured from street curbs or right-of-way.

§ 5 PARKING REGULATIONS.

There shall be provided at the time any building or structure is erected or structurally altered a minimum of two (2) off-street parking spaces per dwelling unit. An off-street parking space is defined in this section of the ordinance as a space located on the lot with a minimum measurement of twenty (20) feet long and twelve (12) feet wide for one space. An off-street parking space has a minimum setback of five (5) feet from the front property line (as illustrated on the survey). Off-street parking, loading spaces, and driveway standards shall be provided in accordance with the provisions of Section XXIII.

§ 6 SITE PLANS.

Construction of the main structure or accessory buildings will require a survey and field notes by a State of Texas licensed surveyor and a site plan prior to a construction permit being issued. Site Plans are drawn to scale and illustrate property lines, setbacks, building lines, parking spaces, driveways, public utilities, and easements. See Section XXXII.

§ 7 CONSTRUCTION.

Property owners will be issued a construction permit upon approval of the site plan and professional residential construction plans. Residential construction permits are issued for 120 days. Property owners and/or permitted contractors will be required to stake off property lines, building lines, and parking spaces prior to inspection by the Chief Building Official for approval to move forward with construction.
