SECTION VIII

R-3 MULTIPLE-FAMILY RESIDENTIAL DISTRICT

§ 1 R-3 MULTIPLE-FAMILY RESIDENTIAL DISTRICT.

The regulations set forth in this Section or set forth elsewhere in this Ordinance when referred to in this Section are the regulations in the R-3 Residential District.

§ 2 USE REGULATIONS.

A building or premises shall be used only for the following purposes:
a. 
Any use permitted in the R-2 Two-Family Residential District or the R-TH Townhouse District.
b. 
Multiple dwelling.
c. 
Medical clinic.
d. 
Rooming house and boarding house.
e. 
Religious, educational, or nonprofit organization organized to promote the welfare of the public, but not a penal or mental institution.
f. 
Hospital devoted primarily to the diagnosis, treatment or care of the sick and injured exclusive of institutions specializing in the care of [or] treatment of mental illness, narcotic addicts, alcoholics and exclusive of institutions operated for the care and treatment of animals.
g. 
Nursing, rest or convalescent home, orphanage or foster home.
h. 
Accessory building or use customarily incidental to any of the above uses, including a storage garage on a lot occupied by a multiple dwelling, house, hospital, or institution.

§ 3 HEIGHT AND AREA REGULATIONS.

The following height and area regulations shall be observed. See also Section XXII - HEIGHT AND AREA EXCEPTIONS AND MODIFICATIONS.

*When two or more buildings are designed and used in combination as a multiple dwelling unit, that has one ownership, one management, common parking area and central control of service, all such buildings shall have a minimum side yard of 25 feet.

§ 4 SETBACKS.

Setbacks are determined from the property lines illustrated from the property survey and field notes. Survey must be conducted by a Texas Licensed Surveyor. Setbacks are not determined and measured from street curbs or rights-of-way.

§ 5 PARKING REGULATIONS.

There shall be provided at the time any building or structure is erected or structurally altered a minimum of two (2) off-street parking spaces per dwelling unit. An off-street parking spaced is defined in this section of the ordinance as a space located on the lot and has a minimum measurement of twenty (20) feet long and ten (10) feet wide for one space. Off-street parking space has a minimum setback of five (5) feet from the front property line (as illustrated on the survey)[.] Off-street parking, loading spaces and driveway standards shall be provided in accordance with the provisions of Section XXIII.

§ 6 SITE PLANS.

Construction of the main structure or accessory buildings will require a survey and field notes by a State of Texas licensed surveyor and a site plan prior to construction permit being issued. Site Plans are drawn to scale and illustrates property lines, setbacks, building lines, parking spaces, driveway, public utilities, easements. See Section XXXII Plans.

§ 7 CONSTRUCTION.

Property owners will be issued a construction permit upon approval of the site plan and professional residential construction plans. Residential construction permits are issued for 120 days. Property owners and/or permitted contractors will be required to stake off property lines, building lines, and parking spaces prior to inspection by the Chief Building Official for approval to move forward with construction.
