SECTION XXXI

CERTIFICATE OF OCCUPANCY AND COMPLIANCE

§ 1 CERTIFICATE OF OCCUPANCY AND COMPLIANCE.

No building hereafter erected or structurally altered shall be occupied, used or changed in use until a certificate of occupancy and compliance shall have been issued by the Chief Inspector, stating that the building or proposed use of a building or premises complies with all the building and health laws and ordinances, and with the provisions of these regulations.
Certificates of Occupancy and Compliance may be issued for buildings erected prior to the adoption of this ordinance which do not comply with the setback and parking regulations of this ordinance, and which are being structurally altered, so long as:
1. 
Such buildings, as altered, comply with the rules and regulations with reference to setback distances and parking regulations existing at the time such building was originally constructed and
2. 
Such alteration does not result in the wall or walls of such building being located closer to the front, side, or rear yard line that [than] the location of the building wall at the time of the adoption of this ordinance, unless the location of such building wall would be permitted under the terms of this ordinance.
No permit for excavation for any building shall be issued before application has been made for certificate of occupancy and compliance.
The use of no building already erected at the passage of this ordinance shall be changed from one class to another unless and until a certificate of occupancy and compliance with the provisions of this Ordinance shall have been obtained from the Chief Inspector.
