CHAPTER 17

08 - DISTRICTS—MAPS—BOUNDARIES

17.08.010 - Establishment of districts.

A.

In order to carry out the provisions of this title, the City of Salisbury is divided into the following zoning districts:

1.

Residence Districts.

a.

R-5, R-8 and R-10;

b.

R-5A, R-8A and R-10A;

c.

R-5S, R-8S and R-10S.

2.

Office and Service Districts.

a.

Office and Service Residential;

b.

Office and Service Highway Nos. 1, 2 and 3.

3.

Business Districts.

a.

Neighborhood Business;

b.

Light Business and Institutional;

c.

General Commercial;

d.

Regional Commercial;

e.

Select Commercial.

f.

Mixed-Use Non-Residential District.

4.

Industrial Districts.

a.

Light Industrial;

b.

Industrial.

5.

Special Districts.

a.

College and University;

b.

Hospital;

c.

Historic;

d.

Conservation;

e.

Paleochannel and Wellhead Protection;

f.

Central Business;

g.

Riverfront Redevelopment Multi-Use District # 1;

h.

Riverfront Redevelopment Multi-Use District # 2.

B.

Planned Districts. The following districts are established in the text of this title and must be approved by the city council as an amendment to the official zoning map. The location of these districts is determined at the time of approval.

RR-5A Residential;

2.

Planned Development;

3.

Planned Residential;

4.

Industrial Park.

17.08.020 - Incorporation of maps.

The location and boundaries of the districts established by this title are shown upon the zoning map, special district overlay maps, floodplain overlay maps and flood profiles, which are incorporated into this title. Such maps, together with everything shown thereon and all amendments thereto, shall be as much a part of this title as if fully set forth and described herein. The official maps shall be signed by the chairman of the planning commission and the president of the city council and shall be kept in the office of infrastructure and development. The director of planning shall be responsible for all amendments to the official maps and verification of copies for distribution.

17.08.030 - Interpretation of district boundaries.

Where uncertainty exists as to the boundaries of districts shown on the official zoning maps, the following rules shall apply:

A.

District boundary lines are intended to follow center lines of streets, highways and waterways or lot lines, corporate boundaries and specific dimensions shown on the official zoning map.

B.

Where dimensions are shown, the district boundary shall be measured in feet along a horizontal plane at right angles to the respective street feature which such dimensions follow. All such measurements shall be taken at the street right-of-way line even if the center line of that street is used for the location of the zoning district boundary on the zoning map.

C.

When a zoning district boundary line crosses a lot of record that was existing as of May 23, 1983, and sixty (60) percent of the lot is in one zoning district and forty (40) percent is in another zoning district, a special exception may be granted to use the entire property for uses allowed in the zoning district that applies to the sixty (60) percent portion of the lot. In addition to the sixty (60) percent requirement, the following restrictions shall apply:

1.

A nonresidential use shall not extend over a lot in a residential district closer than twenty-five (25) feet to a street in a residential district; and the twenty-five-foot area shall be maintained as a landscaped front yard;

2.

When a nonresidential use is extended over a lot in a residential district, a ten-foot-wide screening area shall be provided adjacent to all lot lines in the residential zoning district.
