17.40 BUILDING

PERMIT AND CERTIFICATE OF OCCUPANCY

17.40.010 BUILDING PERMIT REQUIRED

  1. Building Permit: It is unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish any building or structure regulated by this code, except as specified in SMC B of this section, or cause the same to be done without first obtaining a separate permit for each building or structure from the building official.
  2. Exempted Work: A building permit will not be required for the following:
    1. One-story detached accessory buildings used as tool and storage shed, playhouses and similar uses, provided the floor area does not exceed the square footage referred to in the current edition of the IBC (international building code) and/or IRC (international residential code);
    2. Fences not over six feet (6') high;
    3. Oil derricks;
    4. Cases, counters and partitions not over five feet (5') high;
    5. Retaining walls which are not over four feet (4') in height measured from the bottom of the footing to the top of the wall unless supporting a surcharge or impounding flammable liquids;
    6. Water tanks supported directly upon grade if the capacity does not exceed five thousand (5,000) gallons and the ratio of height to diameter or width does not exceed two to one (2:1);
    7. Platforms, walks and driveways not more than thirty inches (30") above grade and not over any basement or story below;
    8. Painting, papering and similar finish work;
    9. Temporary motion picture, television and theater stage sets and scenery;
    10. Window awnings supported by an exterior wall of group R, division 3, and group M occupancies when projecting not more than fifty four inches (54");
    11. Prefabricated swimming pools accessory to a group R, division 3 occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed five thousand (5,000) gallons and less than two feet (2') deep.
  3. Separate Permits For Exemptions: Unless otherwise exempted by this code, separate plumbing, electrical and mechanical permits will be required for the above exempted items.
  4. Violation: Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction.

17.40.020 CERTIFICATE OF OCCUPANCY REQUIRED

No land shall be used or occupied and no building hereafter structurally altered or erected shall be used or changed in use, until a certificate of occupancy shall have been issued by the building inspector, stating that the building or the proposed use thereof, or the use of the land, complies with the provisions of this title or for the renewing, changing or extending of a nonconforming use. A certificate of occupancy either for the whole or a part of a building or structure shall be applied for coincidentally with the application for a building permit, and shall be issued within the ten (10) days after the erection or structural alteration of such building or structure, or part thereof, shall have been completed in conformity with the provision of this title.
