AGRICULTURAL ZONE

17.48.010 PURPOSE

The purpose of the agricultural zone is to preserve appropriate areas of Smithfield City for permanent agricultural use. These regulations are intended to assure areas are provided which will allow for the raising of farm animals while preserving quality land for agricultural activities.

17.48.020 ALLOWED USES

Those uses which are allowed in the agricultural zone either as a permitted use or a conditional use shall be as specified in SMC chapter 17.120, "Use Matrix Table", of this title.

17.48.040 HEIGHT REGULATIONS

No building or structure shall be erected to a height greater than two and one-half (21/2) stories or thirty five feet (35').

17.48.050 FARM ANIMALS

Those agricultural areas within six hundred feet (600') of a commercial, single- or multiple-family residential, or manufacturing zone, and within three hundred feet (300') of a residential agricultural zone shall be limited in the number of farm animals allowed to the following: not more than two (2) cows, two (2) horses, two (2) llamas, four (4) sheep, four (4) goats, twenty (20) rabbits, forty (40) chickens, forty (40) pheasants, ten (10) turkeys, ten (10) ducks, ten (10) geese, three (3) ostriches, four (4) emus, and forty (40) pigeons per acre or portion thereof. Not more than three (3) of the above listed species of animals or fowl are permitted at any one time.

17.48.060 MODIFYING REGULATIONS

  1. Side Yards: Main buildings other than dwellings shall have a minimum side yard of twenty feet (20') and the total of the two (2) side yards shall be at least forty feet (40'). Private garages and other accessory buildings located at least ten feet (10') behind the main building may have a side yard of five feet (5'), except the street side yard of a corner lot shall be a minimum of thirty feet (30') for main and accessory buildings.
  2. Rear Yards:

1.Private garages and accessory buildings located at least ten feet (10') behind the main building may have a rear yard of five feet (5').

2.  Corner lots rearing on the side yard of another lot, the minimum rear yard for all accessory buildings shall be ten feet (10').

C.Distance Between Buildings: No building, structure or enclosure housing animals or fowl shall be constructed closer to a dwelling on the same or adjacent lot than one hundred feet (100').

17.48.070 TEMPORARY MOBILE HOMES

  1. A mobile home may be approved for use as a temporary second dwelling provided the following conditions are met:
    1. A primary dwelling, if present, is in conformance with all provisions of this title.
    2. The mobile home is set back from the front property line a distance equal to or greater than the setback of the primary dwelling should one exist.
    3. The mobile home is connected to water and sewer services in compliance with the provisions of title 13of this code.
    4. The mobile home is placed no closer than five hundred feet (500') to private property in separate ownership unless the owner of such property provides written approval to the city.
    5. No rent is collected for use of the site or the mobile home.
    6. The mobile home shall be occupied by an owner, or employee engaged in an activity on the premises of a permitted agriculture or business operation.
    7. Only one single family occupies the mobile home.
  2. Use of a mobile home as a temporary dwelling may only be permitted after obtaining a conditional use permit.
  3. Expiration of a conditional use permit for a temporary mobile home shall be three (3) years from the date of approval after which time the use must be terminated unless application for another conditional use permit is approved.
  4. Where no primary dwelling exists, a mobile home may be approved as a temporary residence for an owner, or employee engaged in an activity on the premises of a permitted agriculture or business operation; provided, however, that written approval must first be obtained from owners of all adjacent property and further, that no rent may be collected for use of the site or the mobile home.
  5. The planning commission may impose additional requirements relative to placement, screening, time limits and foundations.
