17.08 ADMINISTRATION

17.08.010 BUILDING INSPECTOR TO ENFORCE TITLE

The building inspector, appointed under the provisions of the building code of Smithfield City, is designated and authorized as the officer charged with the enforcement of this title, but the city council of Smithfield City, by resolution or ordinance, may from time to time entrust such administration, in whole or in part, to any other office of Smithfield City without amendment to the ordinance codified in this title.

17.08.020 PERMITS TO COMPLY WITH TITLE

From the time of the effective date hereof, the building inspector shall not grant a permit for the construction or alteration of any building or structure or the moving of a building or structure onto a lot, if such building or structure would be in violation of any of the provisions of this title nor shall any Smithfield City officer grant any permit or license for the use of any building or land if such would be in violation of this title.)

17.08.030 POWERS AND DUTIES OF BUILDING INSPECTOR

It shall be the duty of the building inspector to inspect or cause to be inspected all buildings in course of construction or repair. He shall enforce all of the provisions of this title, entering actions in the court when necessary, and his failure to do so shall not legalize any violation of such provisions. The building inspector shall not issue any permit unless the plans of and for the proposed erection, construction, reconstruction, alteration and use fully conform to all zoning regulations then in effect.

17.08.040 REZONES

The ordinance codified in this title, including the maps, may be amended from time to time by the Smithfield City council. All proposed amendments shall be first submitted to the planning commission for its recommendation. The planning commission shall hold a public hearing after providing notice in conformance with section 10-9a-205, Utah Code Annotated or as said section may be amended. The planning commission's recommendation shall be placed on the next available agenda of the legislative body. The Smithfield City council will review and consider the recommendation of the planning commission and vote to approve or deny the rezone request at a regular council meeting.

17.08.050 AREAS ANNEXED

New areas annexed to Smithfield, Utah shall automatically be classified as being an A-10 zone until such classification shall have been changed by an amendment to this title as provided by law.

17.08.060 LICENSING

All departments, officials and public employees of Smithfield City which are vested with the duty or authority to issue permits or licenses shall conform to the provisions of this title and shall issue no permit or license for uses, buildings or purposes where the same would be in conflict with the provisions of this title, and any such permit or license, if used in conflict with the provisions of this title, shall be null and void.

17.08.070 VIOLATION; PENALTY

Any person, firm or corporation whether as principal, agent, employee or otherwise, violating or causing or permitting the violation of the provisions of this title shall be deemed guilty of a class C misdemeanor and subject to fines and penalties as provided. Upon conviction shall be sentenced to pay a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the county jail for a term not exceeding ninety (90) days. If the person violating this title is a corporation, association, partnership or other governmental instrumentalities, then upon conviction, said corporation, association, partnership or other governmental instrumentality shall be subject to a fine not to exceed one thousand dollars ($1,000.00). Every person, firm or corporation shall be deemed guilty of a separate offense for each and every day during which any portion of any violation of this title is committed, continues or permitted by such person, firm or corporation.

17.08.080 FEES

Any request to amend the zoning map of Smithfield City shall be accompanied by an application for rezone, available at the city office, and the payment of the required fee as set forth in the most recent prevailing fee schedule adopted by resolution of the city council.
