17.60 RM

MULTIPLE-FAMILY RESIDENTIAL ZONE

17.60.010 PURPOSE

The purpose of the multiple-family residential zone is to provide areas of the community which shall be characterized by low rise multiple-family and apartment development. This zone is intended to provide an attractive setting for multiple-family apartments, condominiums, and one- and two-family dwellings which will be harmoniously blended together.

17.60.020 ALLOWED USES

Those uses which are allowed in the multiple-family residential zone either as a permitted use or a conditional use shall be as specified in SMC 17.120, "Use Matrix Table", of this title.

17.60.030 AREA, WIDTH, DENSITY AND YARD REGULATIONS

  1. Minimum Yard Requirements: Minimum yard requirements shall be as follows:

    Minimum area requirements for the first dwelling unit shall be seven thousand five hundred (7,500) square feet and four thousand (4,000) square feet for each additional dwelling unit up to ten (10) units, then ten (10) units/acre maximum density thereafter. For example:

    Single dwelling 7,500 square feet
    Duplex  11,500 square feet 
    Fourplex  19,500 square feet  
    Sixplex  27,500 square feet 
    Eightplex  35,500 square feet 
    10 units  1 acre  
    15 units 1.5 acres, etc. 
  2. Density: Density shall be based on the gross area of the property being developed exclusive of any public rights of way.
  3. Density Bonus And Incentives: The city council, upon recommendation of the planning commission, may determine the density bonus upon the city council's acceptance of the design options, as set forth below. The actual bonus awarded for each incentive shall be reflective of the effort made by the developer to meet the intent of the incentive and shall be determined by the city council.

    Fencing - up to a maximum 5% bonus  All perimeter fencing shall be uniform in design including architecturally designed brick or masonry, vinyl with brick or stone columns, solid or semiprivate vinyl fencing, and open fencing such as vinyl rail or wrought iron may be used in conjunction with landscaping

17.60.040 HEIGHT REGULATIONS

No building or structure shall be erected to a height greater than fifty feet (50'), to be measured from the threshold of the main entrance at street level to the highest point of the roof. Accessory buildings and other buildings shall not be erected to a height greater than the dwelling, but in no case shall it exceed twenty feet (20') in height. Excluding Master Planned Community (MPC) Zone.

17.60.050 MODIFYING REGULATIONS

Modifying regulations in the RM multiple-family residential zone are as follows:

  1. Front Yards: On corner lots, the least of the two (2) front yards shall be a minimum of twenty feet (20') and the combination of the two (2) together shall total a minimum of fifty feet (50').
  2. Side Yards: Main buildings other than dwellings shall have a minimum side yard of twenty feet (20'). Private garages and other accessory buildings located at least ten feet (10') behind the main building may have a side yard of five feet (5'), except that the street side yard on a corner lot shall be a minimum of thirty feet (30') for main and accessory buildings.
  3. Rear Yards:
    1. Private garages and accessory buildings located at least ten feet (10') behind the main building may have a rear yard of five feet (5').
    2. Corner lots rearing on the side yard of another lot, the minimum rear yard setback for all accessory buildings shall be ten feet (10'). .
    3. A maximum of two (2) architectural projections or pop outs such as bay windows, exclusive of foundations, shall be allowed to encroach into the required rear yard provided such projection does not exceed a depth of forty two inches (42") or a width of ten feet (10').
    4. Unsheltered decks, supported by posts and which are less than thirty inches (30") above the ground or greater than eighty four inches (84") above the ground but, not greater than the uppermost floor level, shall be allowed to project into the required rear yard a maximum of twelve feet (12').
  4. Dwelling Area: Each dwelling unit shall contain a minimum of eight hundred fifty (850) square feet of living area.

17.60.060 GROUP DWELLING STANDARDS

The following provisions shall apply to the development of group dwellings as defined in SMC 17.04 of this title:

  1. Group Dwellings: Group dwellings shall be owned by one person, partnership, or legal entity and shall not be divided and sold as individual buildings.
  2. Open Space:
    1. Open space shall be provided and shall not cover less than fifty percent (50%) of the gross site area. The required open space shall be land areas that are not occupied by buildings, structures, parking areas, streets or alleys. Said open space shall be devoted to landscaping, preservation of natural features, patios and recreational areas.
    2. At least fifty percent (50%) of the required open space shall be designated for use as common open space for common enjoyment and use for all residents of the development. Private open space (that provided for each dwelling unit for personal use) shall be located immediately adjacent to, attached to, or within the dwelling unit it is designed to serve and shall be for the exclusive use of the residents of that dwelling unit. Landscaped roof areas or decks attached to individual units may not be calculated as part of the required common open space.
  3. Building Orientation: No residential building shall face the rear of another building on the development site.
  4. Side By Side Buildings: A separation of at least twenty feet (20') shall be maintained between buildings which are located side by side.
  5. Buildings Facing One Another: The minimum distance between the fronts of buildings which face one another shall be thirty feet (30').
  6. Additional Conditions: The planning commission may impose other reasonable conditions as may be necessary to accomplish the purpose of this title.

17.60.070 PARKING, LOADING AND ACCESS

  1. Each lot or parcel in the RM zone shall provide minimum ten foot by eighteen foot (10' x 18') parking stalls located and in numbers as described below.
  2. All parking spaces shall be paved with asphaltic cement or concrete, and shall be provided with paved access from a public street.
  3. Parking spaces shall not be provided within a required front yard.
  4. Each dwelling unit shall be provided with at least two (2) parking spaces of which one and one-half (11/2) spaces per unit shall be covered. The covering provided shall be a permanent structure of such size as to provide protection from the weather. Materials shall be such that the structure will be compatible with the dwelling units and not detract from the overall appearance of the development.
  5. There shall be provided one-fourth (1/4) parking spaces per unit for guest parking.
  6. All parking areas, covered or open, shall have a minimum four foot (4') landscaped buffer adjacent to any public right of way, private accessway, or sidewalk.

17.60.080 LANDSCAPING

The following landscaping provisions shall apply in all multiple housing developments within the RM zone:

  1. All open space shall be maintained with suitable landscaping of plants, shrubs, trees, grass and similar natural landscaping materials.
  2. Initial landscaping shall include at least one tree per two (2) units, half of which shall be coniferous and half deciduous, and one shrub for each ten (10) linear feet of the perimeter of the property.
  3. There shall be provided a minimum of three feet (3') of landscaped area around the front foundation of all buildings dedicated to foundation planting, ground covers or natural landscaping such as lava rock or bark. In areas where natural landscaping is used a weed barrier or block shall be used to prevent the encroachment of weeds or grass into the landscaped area.
  4. In required landscaped areas, all trees shall be a minimum two inch (2") caliper trunk, and all shrubs shall be a minimum of five (5) gallon size.
  5. All areas to be landscaped with sod shall have sprinklers and/or irrigation systems. All other landscaped areas shall be provided with drip or other approved irrigation systems as approved by the planning commission.
  6. The area between the curb or street line and the public sidewalk shall be landscaped and maintained by the owner of the property fronting the street.
  7. All landscaped areas shall be kept free of weeds and be maintained in a healthy condition. All required vegetation that dies shall be promptly replaced during the current growing season.

17.60.090 ARCHITECTURAL DESIGN GUIDELINES

Multiple housing areas have historically been perceived as being unsightly, unkempt and a detraction to the community. In an effort to promote and preserve areas for multiple housing basic minimum architectural standards are established as a means of ensuring such developments will be compatible, blend in with surrounding residential areas, and be acceptable to the public in general. With that goal in mind, the following minimum standards are set forth:

  1. Mechanical Equipment: All electrical service equipment and subpanels and all mechanical equipment, including, but not limited to, air conditioners, pool equipment, fans and vents, utility transformers (except those owned and maintained by public utility companies) and solar panels, shall be painted to match the surrounding wall color or painted or screened to blend with the surrounding natural terrain. Roof mounted equipment and vents shall be painted to match the roof and/or adjacent wall color and shall be screened or integrated into the design of the structure.
  2. Facade Length And Variations:
    1. Structures greater than sixty feet (60'), but less than one hundred twenty feet (120') in length must exhibit a prominent shift in the facade of the structure so that no greater than seventy five percent (75%) of the length of the building facade appears unbroken. Each shift shall be in the form of either an accumulative eight foot (8') change in building facade alignment or an accumulative eight foot (8') change in roofline height, or a combination change in facade and roofline height totaling eight feet (8').
    2. Structures which exceed one hundred twenty feet (120') in length on any facade shall provide a prominent shift in the mass of the structure at each one hundred twenty foot (120') interval (or less if the developer desires) reflecting a change in function or scale. The shift shall be in the form of either an accumulative sixteen foot (16') change in building facade alignment or an accumulative sixteen foot (16') change in roofline. A combination of both a roofline and facade change is encouraged and to that end, if the combination occurs at the same location in the building plane, a sixteen foot (16') total change will be considered as full compliance.
    3. In addition to meeting the requirements established herein for buildings which exceed one hundred twenty feet (120'), the provisions established in SMC B1 of this section shall also be satisfied for those building intervals created through adherence to SMC B2 of this section.

17.60.100 TRASH

Trash shall not be stored in an open area. All trash containers shall be screened from public streets and adjacent properties with a six foot (6') sightproof fence or wall. Openings of trash enclosures shall be oriented away from public view or screen with sturdy gates wide enough to allow easy access for trash collection. No trash containers or trash enclosures may be located within a required front yard or street side yard setback.
