165.19 NEIGHBORHOOD

COMMERCIAL ZONE CN-1.

The Neighborhood Commercial Zone (CN-1) is intended to permit the development of retail sales and personal services required to meet the day-to-day needs of a fully-developed residential neighborhood.  Stores, businesses and offices in this zone should be useful to the majority of the neighborhood residents, should be economically supportable by nearby population, should not draw community-wide patronage and should be developed upon full development of the surrounding residential neighborhoods.  A grocery store or grocery store, drugstore combination is favored as the principal tenant in a neighborhood commercial zone.  In general, the CN-1 Zone is intended for the grouping of a grocery store and small retail businesses and office uses which are relatively nuisance-free to surrounding residences and which do not detract from the residential purpose and character of the surrounding neighborhood.  The location and development of neighborhood commercial sites should follow the criteria set forth for such sites in the Comprehensive Plan.
1.   Permitted Uses.
   A.   Barber shops and beauty parlors, Laundromats, and laundry and dry cleaning pickup and delivery services.
   B.   Drugstores, florist shops and variety stores.
   C.   Financial institutions, branch offices.
   D.   Retail bakeries.
   E.   U.S. postal station.
   F.   Videotape rental store.
2.   Provisional Uses.
   A.   Grocery stores, including specialty food such as bakery and delicatessen goods, provided that the floor area of a grocery store does not exceed ten percent (10%) of the land area of the CN-1 Zone in which the grocery store is located.
3.   Conditional Uses.
   A.   Child daycare facilities subject to the requirements of Section 165.30.
   B.   Drive-in facilities for financial institutions.
   C.   Filling stations, provided that no part of the filling station site is located within 100 feet of an R Zone boundary.
   D.   Offices in which no activity is carried on catering to retail trade with the general public and no stock of goods is maintained for sale to customers except for those retail establishments specifically allowed in this zone, provided that:
      (1)   No office establishment shall occupy more than 1,800 square feet of floor area.
      (2)   The total floor area of all office uses within an area zoned CN-1 shall not exceed fifteen percent (15%) of the total floor area, either existing or proposed, in the zone.  (To determine the area zoned CN-1, any streets contained within the zone shall be disregarded.)
      (3)   The location of the building in which the office is located does not diminish convenient access to retail sales and personal service businesses.
   E.   Public utilities.
   F.   Religious institutions.
   G.   Restaurants.
   H.   School - specialized private instruction.
4.   Dimensional Requirements.
   A.   Minimum Lot Area:  None
   B.   Minimum Lot Width:  None
   C.   Minimum Lot Frontage:  None
   D.   Minimum Yards:
      (1)   Front - 25 feet
      (2)   Side - None
      (3)   Rear -    None
   E.   Maximum Building Bulk:
      (1)   Height - 25 feet  (If any building or structure is to be located in an area regulated by the Mason City Municipal Airport Zoning Ordinance, any lower height regulation of such ordinance shall prevail.)
      (2)   Lot Coverage - None
      (3)   Floor Area Ratio - 1
5.   General Provisions.  All principal and accessory uses permitted within this zone are subject to the requirements of the following sections of this chapter:
   A.   Permitted Accessory Uses and Buildings – See Section 165.31.
   B.   Accessory Use and Building Regulations – See Section 165.32.
   C.   Off-street Parking Requirements – See Section 165.33.
   D.   Off-street Loading Requirements – See Section 165.34.
   E.   Sign Regulations – See Section 165.35.
   F.   Fence Regulations – See Section 165.36.
   G.   Dimensional Requirements – See Sections 165.37 through 165.40.
   H.   Tree Regulations – See Section 165.41.
   I.   Performance Standards – See Sections 165.42 and 165.43.
   J.   Nonconformities – See Section 165.44.
6.   Special Provisions.
   A.   In no instance shall an area zoned CN-1 be less than three (3) acres or more than seven (7) acres.
   B.   Religious institutions which existed before the adoption of this chapter may expand without compliance with the dimensional requirements or the off-street parking requirements.
