165.31 PERMITTED

ACCESSORY USES AND BUILDINGS.

Accessory uses, buildings or other structures customarily incidental to and commonly associated with a permitted use, provisional use or conditional use shall be permitted provided they are operated and maintained under the same ownership, located on the same lot (except as otherwise provided), do not include structures or structural features inconsistent with the uses to which they are accessory and conform to the specific requirements contained herein.  The accessory uses, buildings or other structures permitted in each zone may include the following:
1.   In the ID Zone.
   A.   Repealed by Ord. 721 - July 04 Supp.
   B.   Fences as regulated by Section 165.36.
   C.   Gazebos, enclosed patios and similar buildings for recreational use.
   D.   Home occupations, provided that no home occupation shall be permitted in which there is associated therewith:
      (1)   Any commodity sold upon the premises, except that which is produced thereon or is accessory to the home occupation conducted on the premises.
      (2)   Any disturbance such as noise, vibration, smoke, dust, odor, heat or glare beyond the confines of the principal or accessory building.
      (3)   Any exterior display, exterior storage of materials, signs (except as otherwise permitted in Section 165.35), house calls after 10:00 p.m. or before 7:00 a.m., or other indication from the exterior that the dwelling unit or accessory building is being used in part for any use other than that of a dwelling or accessory building for purely residential purposes.
   E.   Off-street parking as regulated by Section 165.33.
   F.   Private garages.
   G.   Private greenhouses or conservatories.
   H.   Private recreational uses and facilities including, but not limited to, swimming pools and tennis courts.
   I.   Roadside stands for the sale of produce grown on the premises, provided that such a stand shall not contain more than 600 square feet of floor area, the stand is located not less than 20 feet from a street and access to the stand is from an entrance to the farm or residence.
   J.   Signs as regulated by Section 165.35.
   K.   Structures for the shelter of household pets, except kennels.
2.   In the RR-1, RS-5, RS-8 and RFMH Zones.
   A.   Repealed by Ord. 721 - July 04 Supp.
   B.   Fences as regulated by Section 165.36.
   C.   Gazebos, enclosed patios and similar buildings for passive recreational use.
   D.   Home occupations, provided that no home occupation shall be permitted in which there is associated therewith:
      (1)   Any commodity sold upon the premises, except that which is produced thereon or is accessory to the home occupation conducted on the premises.
      (2)   Any disturbance such as noise, vibration, smoke, dust, odor, heat or glare beyond the confines of the principal or accessory building.
      (3)   Any exterior display, exterior storage of materials, signs (except as otherwise permitted in Section 165.35), house calls after 10:00 p.m. or before 7:00 a.m., or other indication from the exterior that the dwelling unit or accessory building is being used in part for any use other than that of a dwelling or accessory building for purely residential purposes.
      (4)   Employees other than those residing on the premises.
   E.   Horses and ponies and structures for the shelter of horses and ponies, except commercial stables, shall be permitted in the RR-1 Zone but not in the RS-5, RS-8 and RFMH Zones.  The minimum lot area provided shall be two (2) acres for the first horse or pony, plus one (1) acre for each additional horse or pony.  Structures and fenced areas shall be located no closer than 250 feet from any residence now existing or hereafter erected.
   F.   Off-street parking for a use permitted in the zone in which the off-street parking is located, as regulated by Section 165.33.
   G.   Private garages as long as it is not the principal use.
   H.   Private greenhouses or conservatories.
   I.   Private recreational uses and facilities, including but not limited to swimming pools and tennis courts.
   J.   Signs as regulated by Section 165.35.
   K.   Storage building for the storage of wood, lumber, gardening equipment and other materials and equipment exclusively for the use of the residents of the premises but not including a storage building for commercial purposes and provided that only one such building shall be permitted on a lot.
   L.   Structures for the shelter of household pets, except kennels.
3.   In the LR Zone.
   A.   No structures shall be placed closer than the rear building lines (see Figure 7) or closer than 5 feet from any side lot line.
   B.   Fences as regulated by Section 165.36.
   C.   Gazebos, enclosed patios and similar buildings for passive recreational use.
   D.   Home occupations, provided that no home occupation shall be permitted in which there is associated therewith:
      (1)   Any commodity sold upon the premises, except that which is produced thereon or is accessory to the home occupation conducted on the premises.
      (2)   Any disturbance such as noise, vibration, smoke, dust, odor, heat or glare beyond the confines of the dwelling unit or accessory building.
      (3)   Any exterior display, exterior storage of materials, signs (except as otherwise permitted in Section 165.35), house calls after 10:00 p.m. or before 7:00 a.m., or other indication from the exterior that the dwelling unit or accessory building is being used in part for any use other than that of a dwelling or accessory building for purely residential purposes.
      (4)   Employees other than those residing on the premises.
   E.   Off-street parking for a use permitted in the zone in which the off-street parking is located, as regulated by Section 165.33.
   F.   Private garages.
   G.   Private greenhouses or conservatories.
   H.   Private recreational uses and facilities, including but not limited to swimming pools and tennis courts.
   I.   Signs as regulated by Section 165.35.
   J.   Storage building for the storage of wood, lumber, gardening equipment and other materials and equipment exclusively for the use of the residents of the premises but not including a storage building for commercial purposes and provided that only one such building shall be permitted on a lot.  No storage or accessory building shall be placed closer than the rear building line or closer than five (5) feet from any side lot line.
   K.   Structures for the shelter of household pets, except kennels.
4.   In the RM-12, RS-12, RM-20 and RM-44 Zones.  In addition to the accessory uses included in the preceding subsection 2 of this section, storage buildings and off-street loading shall be permitted.
5.   In the C Zones.
   A.   For residential uses, the accessory uses included in the preceding subsection 4 shall be permitted.
   B.   For commercial or manufacturing uses, there may be any accessory use provided that:
      (1)   Except in the CI-1 Zone, the floor area for storage and warehousing shall not exceed forty percent (40%) of the total floor area.
      (2)   Fences are erected according to Section 165.36.
      (3)   Off-street parking and loading are provided according to Sections 165.33 and 165.34.
      (4)   Signs are erected according to Section 165.35.
      (5)   A communication tower’s distance from an R zone shall be at least equal to the height of the tower.
6.   In the OBP and I Zones.  There may be any accessory use including, but not limited to, printing, publishing, design, development, fabrication, assemblage, storage and warehousing and child daycare facilities provided that:
   A.   Fences are erected according to Section 165.36.
   B.   Off-street parking and loading are provided according to Sections 165.33 and 165.34.
   C.   Signs are erected according to Section 165.35.
   D.   A communication tower’s distance from an R zone is at least equal to the height of the tower.
