165.38 PERMITTED

OBSTRUCTIONS IN YARDS.

The following obstructions may be located in the required yards specified subject to the special conditions indicated.
1.   Buildings, Accessory.  Accessory buildings may be located in any yard except the front yard, provided they shall comply with the requirements of Section 165.32.
2.   Building Features.  Eaves, cornices, marquees, awnings, canopies, belt courses, sills, buttresses or other similar building features which extend beyond the wall of a building may project into any yard provided that such projections from a principal building shall not be closer than two (2) feet to any side lot line.  Such projections from an accessory building shall not be closer than one (1) foot to a rear lot line or a side lot line.
3.   Canopy, Gas Pump Island.  Unenclosed canopies over gas pump islands may be located in the required front yard provided the supports shall be no closer than 10 feet to the right-of-way line.
4.   Chimneys.  Chimneys may project into any yard not more than two (2) feet.
5.   Dog Runs.  Dog runs constructed solely for the purpose of confining dogs for exercising and feeding may be located in any yard, provided that in an R Zone they shall not be located in a front yard or side yard nor closer than 10 feet to a rear lot line.
6.   Fences, Walls and Hedges.  Fences, walls and hedges may be located in any yard subject to the requirements of Section 165.36.
7.   Fire Escapes and Unenclosed Stairways.  Fire escapes and unenclosed stairways may extend into any yard provided they shall not extend into a side yard more than three and one-half (3 ½) feet.
8.   Fuel Dispensing Equipment.  In commercial and industrial zones, fuel dispensing equipment may be located in any yard.
9.   Ornamental Features.  Light fixtures, flag poles, arbors, trellises, fountains, sculptures, plant boxes, plants and trees and other similar ornamental features may be located in any yard, provided that:
   A.   At street intersections, no ornamental features more than two (2) feet in height above the curb level shall be located within a triangular area two (2) of its sides 30 feet in length and measured along the rights-of-way lines from the point of intersection (see Figure 1).
   B.   Trees planted in the front yard shall comply with the location requirements of Section 165.41 and the List of Recommended Trees for the City of Clear Lake and other provisions of this Code of Ordinances.
10.   Parking, Off-Street.  Except as otherwise provided in Section 165.33, open off-street parking may be located in any yard.
11.   Porches, Balconies, Decks and Stoops, Paved Terrace, Uncovered and Unenclosed.  Porches, balconies, decks, stoops and terraces which are uncovered and unenclosed may extend into any yard provided that such projections shall not exceed into a front yard more than ten (10) feet.  Stoops may extend into a side yard not more than two (2) feet.  An unenclosed vestibule containing not more than 40 square feet may project into a front yard for a distance not to exceed 4 feet.
12.   Signs.  Except as otherwise provided in Section 165.35, signs may be located in any yard.
13.   Swimming Pools and Hot Tubs.  Swimming pools and hot tubs with a depth of 18 inches or more may be located in any yard, provided that in an R Zone they shall not be located in a front yard and shall not be located closer than 10 feet to a side or rear lot line.
14.   Telephones, Coin Operated.  In commercial and industrial zones, coin-operated telephones may be located in any yard.
15.   Windows.  Bay windows and similar projecting windows may extend into any yard provided that in an R Zone they shall not extend into the side yard or the rear yard of a reversed corner lot.
