32 - R-4 RESIDENTIAL DISTRICT
The R-4 residential zone district shall be governed in conformity with the following regulations.

This R-4 district is established to provide low-density residential areas permitting agricultural, farming and ranching activities including animals. This R-4 district may be used as a buffer along and adjacent to public lands, and where existing agricultural land exists.

It is the town's goal to enable agricultural activities within this district with small acreage ranches and farms permitting limited animals and birds.

Permitted uses shall be as follows:
A.
Single-family dwellings;
B.
Animals (see Section 17.32.130);
C.
Animal structures and shelters;
D.
Agricultural;
E.
Grazing;
F.
Public park and open space;
G.
Home occupation;
H.
Public utilities;
I.
Accessory use.
J.
Family child care home.

Conditional uses shall be as follows:
A.
Animals (other);
B.
Church;
C.
School;
D.
Home occupation;
E.
Fire station;
F.

Minimum lot area shall be as follows:
A.
Residential: one acre;
B.
Residential with animals: two and one-half acres;
C.
Nonresidential or commercial use: five acres.

Minimum floor area shall be one thousand (1,000) square feet.

2.
Rear yard: fifty (50) feet,
3.
Side yard: fifty (50) feet,
4.
Between buildings or pens: twenty (20) feet;
C.
Tree and fruit farms—center of tree trunk: twenty (20) feet.

Maximum building height shall be thirty (30) feet.

Minimum off-street parking shall be as follows:
A.
Residential: three spaces;
B.
Others: as determined by the town council.

Any animals and birds that are used or raised on a ranch or farm in Colorado and where such animals or birds are not regulated or restricted by the state of Colorado or other governmental agency are permitted. Any animal or bird not described in the following categories shall require special review by the town council:
A.
Grazing animals: such as and including, but not limited to, horses, mules, donkeys, sheep, or cattle.
B.
Penned animals: such as and including, but not limited to, pigs or rabbits.
C.
Birds: such as and including, but not limited to, chickens and tame ducks, geese, or swans.

All lots permitting animals or birds are required to be fenced as described herein prior to permitting animals or birds on the lot.
A.
No electrical fences shall be permitted on the lot line or boundary fence line.
B.
No barbed wire fences shall be permitted on the front lot line or within the front yard setback fifty (50) feet.
C.
Any lot owner planning to have grazing animals shall construct or install a fence at least four feet in height along the lot lines adequately to retain the animals within the lot.
D.
No fence shall be required along the front lot line or side lot lines where another such fence is installed from one side lot line fence to the other side lot line fence.
E.
Grazing animal fences and corrals may be installed within the lot in addition to the required lot line fence.
F.
Penned animals shall be fenced and/or penned separately from the lot line fences within the lot and in accordance with the setback requirements described in Section 17.32.100(B). The fence and pen shall be constructed adequately to retain the animals within their penned area.
G.
Birds shall be required to have a fence or pen at least eight feet in height with a fenced roof to adequately retain the birds within their pen. No roof shall be required for chickens, tamed ducks, geese or swans. The pen and fence shall be in accordance with the setback requirements described in Section 17.32.100(B).
H.
In the event the adjoining lot owner(s) has constructed a fence along the lot line, it shall be the lot owner's responsibility to make sure such fence is adequate enough for his or her animals or make arrangements with the adjoining lot owner to improve the fence to meet the requirements for his or her animals.
I.
It shall be the responsibility of the lot owner to maintain the required fences and pens and to make arrangements with the adjoining lot owner to maintain such common fence.
J.
In the event the adjacent lot owner(s) has installed a fence, the lot owner shall provide the town with a copy of an agreement between lot owners on conditions of how they shall maintain the common fences.
