CHAPTER 17

52 - INDUSTRIAL DISTRICT

17.52.010 - Generally.

The industrial zone district shall be governed in conformity with the following regulations.

17.52.020 - Description.

The purpose of the industrial district is to provide an area for industrial development in the town with minimal adverse environmental effects on the town.

17.52.030 - Permitted uses.

Permitted uses shall be as follows:

A.

Office for conduct of a business or profession;

B.

Wholesale and retail sales establishments which sell the following: building construction products, materials or supplies; electric and mechanical supplies and equipment; petroleum products and supplies; steel and steel fabrication products; propane products and supplies; and lumber products and supplies;

C.

Warehouse;

D.

Self-storage facilities;

E.

Petroleum storage;

F.

Outdoor commercial recreational use;

G.

Recreation vehicle park;

H.

Bottling plant;

I.

Propane storage;

J.

Public park/open space;

K.

Fire station;

L.

Police station;

M.

Ambulance service;

N.

Municipal service structures.

17.52.040 - Nonpermitted uses.

The following uses are not permitted:

A.

Auto wrecking and salvage yard;

B.

Auto storage yard;

C.

Truck repair and storage yard;

D.

Mobile home repair;

E.

Mobile home park;

F.

Asphalt batch plant;

G.

Concrete block and mixing plant;

H.

Concrete storage yard;

I.

Gravel extraction;

J.

Gravel storage;

K.

Mining operations.

17.52.050 - Conditional uses.

Any use not specifically defined in the permitted or nonpermitted use categories shall be conditional use. Adult entertainment establishments may also be located in the zone district subject to conditional use approval pursuant to Chapter 17.84 and compliance with relevant provisions of the New Castle Municipal Code.

17.52.060 - Zone requirements.

A.

All service, fabrication, repair operations and storage of materials shall be enclosed by a fence at least six feet in height. Fences and gates shall be constructed of galvanized chain link.

B.

All loading and unloading of materials shall be conducted on private or town-leased property.

C.

All practical means shall be used to confine odor, noise, glare and vibration to the site, and to avoid excessive emission of fumes, gases, radiation, liquid waste and smoke.

D.

All property lines adjacent to the New Castle public parks are to be screened with trees and shrubs approved by the New Castle parks and recreation committee, and shall be in compliance with the tree city requirements as specified in Chapter 12.20. All property which is not adjacent to the New Castle public parks shall be screened with trees and shrubs on at least twenty-five (25) percent of their private property lines in compliance with Chapter 12.20, and with the approval of the New Castle parks and recreation committee. Review of screening by the parks and recreation committee shall be completed prior to the issuance of a building permit.

17.52.070 - Minimum lot area.

Minimum lot area for lots devoted wholly or partially to wholesale or retail sales shall be twenty thousand (20,000) square feet.

17.52.080 - Minimum yard setback.

Minimum yard setback shall be as follows:

A.

Front: twenty-five (25) feet;

B.

Rear: ten (10) feet;

C.

Side: five feet.

17.52.090 - Maximum building height.

A.

Maximum wall height of buildings, additional storage, or structural facilities shall be thirty (30) feet.

B.

Maximum number of building stories, excluding basements, shall be two stories.
