068 AMUSEMENT HALL/RETAIL COMMERCIAL AH/C-1 OVERLAY ZONE

17.068.010 Purpose of zone.

   The amusement hall/retail commercial or AH/C-1 overlay zone is established to control the placement and conduct of new and existing amusement halls in retail commercial (C-1) zones.

17.068.020 Criteria and standards.

   1.   The establishment, placement or operation of a new amusement hall as defined in Section 17.006.0063 is hereby prohibited within the AH/C-1 overlay zone and no existing amusement hall in said overlay zone shall be expanded or permitted to install additional amusement devices.
   2.   The continuing operation of any existing amusement hall within the AH/C-1 overlay zone shall be subject to the provisions of City Ordinance #301, including, without limitation, requirements for licensing and adult supervision set forth in said ordinance.
   3.   The location of two or fewer city licensed mechanical amusement devices per each licensed business shall be exempted from the prohibitions of this overlay zone.
   4.   The boundaries of the AH/C-1 overlay zone shall be limited to the districts identified in the AH/C-1 overlay zone map.
   5.   All amusement halls in C-1 or C-2 zones outside the boundaries of the AH/C-1 overlay zone shall be located a minimum of five hundred feet from any R-1, R-2, R-3, MH or P-R zone and a minimum of five hundred feet from any other amusement hall or adult business.
   6.   All actions taken under this overlay zone shall be consistent with the relevant goals, policies and programs of the general plan/local coastal program land use plan.
