45 - NONCONFORMING USES

The lawful use of land existing at the time of the passage of the ordinance codified in this title, although such use does not conform to the provisions of this title, may be continued, but if such nonconforming use is discontinued in fact for one year or more, any future use of the land shall be in conformity with the provisions of this title. Further, the exemption of nonconforming uses or structures shall not apply to obsolete and deteriorated signs of all types, private or public; fencing or shrubbery; obsolete and abandoned structures; obsolete, inoperative, dismantled or partially dismantled machinery, vehicles or implements that are parked, stored, or located in or on any street, right-of-way, easement, or setback. The lawful use of a building existing at the time of the passage of the ordinance codified in this title, may be continued, although such use does not conform with the provisions of this title, and such use may be extended throughout the building, provided no structural alterations, except those required by law or ordinance, are made therein. If such nonconforming building is removed, every future use of the land shall be in conformity with the provisions of this title. (Ord. 46-1969 § 501.2, 1969)
Nothing in this chapter shall be deemed to prevent the restoration or use of a building destroyed to the extent of not more than sixty-five percent of its reasonable value by casualty. (Ord. 46-1969 § 502.1, 1969)
