SOUTH SALEM STREET OVERLAY DISTRICT

15-38.1.- Purpose.

The purpose of this Overlay District is to provide flexibility to promote development which will enhance the identity of the South Salem Street area as a regional center. The proposed uses shall be compatible with the character as described in the Master Plan. The intent is to promote a balanced mixed use area which establishes new services, facilities and housing opportunities. The following zoning requirements shall be used with the overlay design standards found in Section 15-62 to promote the purpose and intent of this District.

15-38.2. - Principal uses.

1.

Any principal use as permitted in the underlying zone district.

2.

Retail sales and services.

3.

Restaurants.

4.

Furniture and home furnishing stores.

5.

Business or professional offices, banks and fiduciary institutions.

15-38.3. - Accessory uses.

1.

Customary accessory uses to the uses permitted above.

2.

Outdoor storage, pursuant to the requirements in Section 15-42.

15-38.4. - Conditional uses.

1.

Conditional uses, pursuant to the requirement section of the underlying zone.

2.

Residential uses with designs consistent and compatible with the South Salem Street concept in the Master Plan pursuant to Section 15-35.10. Consideration shall be given to affordable and senior housing units which offer a variety of housing types and opportunity.

15-38.5. - Prohibited uses.

Any use other than those listed above is prohibited and, in addition, the following uses are specifically prohibited; unless permitted in [the] underlying zone.

1.

Public garages, gasoline service stations and gasoline filling stations.

2.

Drive-in restaurants.

15-38.6. - Area and bulk requirements.

1.

Minimum lot area: 15,000 square feet.

2.

Minimum lot dimensions: Neither the width nor depth of any lot shall be less than 125 feet.

3.

Minimum front yard: 15 feet except when building fronting on Route 10, then 75 feet.

4.

Minimum side yard: 20 feet for one side yard.

5.

Minimum rear yard: 25 feet; unless parcel abuts a residential use or zone, then 35 feet.

6.

Maximum height: 2½ stories or 40 feet.

7.

Maximum floor area ratio: .18.

8.

Maximum density of second floor apartments: 4 per acre.

15-38.7. - Other requirements.

1.

All uses shall be served by public sewer and water.

2.

Any residential use with direct access to a public bus route may increase the permitted density by 5% to encourage public transit usage.

3.

The approving agency may permit an additional increase in a project FAR by .02 if the project design includes a public space such as a courtyard, plaza, or other desired amenity.
