170.10 PENALTIES

Any person, firm or corporation, agent, employee, or contractor who violates, disobeys, omits, neglects, or refuses to comply with or who resists enforcement of any provision of this Zoning Code, commits a municipal infraction and as such will be subject to the penalties and remedies specified in Chapter 3. In the event that any building, structure, or use is erected, constructed, reconstructed, altered repaired, converted, or maintained; or any building, structure, or land is used in violation of this Zoning Code, the Council, in addition to other remedies, may institute an action for injunctive relief or any proper action or proceedings in the name of the City to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use; to restrain, correct, or abate such violation; to prevent the occupancy of such building, structure, or land; or to prevent any act, conduct, business, or use in or about such premises in violation of this Zoning Code. Any building erected, raised, or converted, or land or premises used in violation of any provisions of this Zoning Code or the requirements thereof, is hereby declared to be a public nuisance, and as such, in addition to the remedy provided above, may be abated in such manner as nuisances are now or may hereafter be abated under this Code. Further, any person, firm or corporation, agent, employee, or contractor of such who seeks an after-the-fact remedy to an infraction of this code through the use of any administrative process allowed herein shall be charged double the listed application fees.
