170.20 MULTI-FAMILY

RESIDENTIAL DISTRICT R-3.

1.   General Description. This district is composed of certain medium-density residential areas representing a compatible commingling of single-family, two-family, single-family attached, and multi-family dwellings, including certain open areas where similar residential development appears likely to occur. It is the intent of this district to provide for an environment of medium-density dwellings plus certain additional uses such as schools, parks, churches, and certain public facilities which serve the residents living in the district. Large apartments, with corresponding proportions of open space, also may be developed under prescribed standards of density and open space. In addition to large areas allocated for this district, it has useful application as a buffer or transition zone along major streets and bordering commercial development. Single-family attached dwellings shall only be constructed on parcels containing two or more acres and shall contain no more than 12 dwelling units per building.
2.   Principal Uses Permitted. Property and buildings in a Multi-Family Residential District (R-3) will be used only for the following purposes:
   A.   Any use permitted in the One- and Two-Family Residential District.
   B.   Dwellings for any number of families.
   C.   Bed and breakfast establishments.
   D.   Boarding houses.
   E.   Single-Family attached dwellings.
   F.   Short-term rentals.
   G.   Planned Development District (PDD).
   H.   Accessory uses or buildings which are customarily incidental to any of the above stated uses.
3.   Special Exceptions. The following principal uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained herein:
   A.   Any use permitted on review in the One- and Two-Family Residential District.
   B.   Hospitals, sanitariums, and long-term care facilities.
   C.   Institutions of a religious, educational, or philanthropic nature.
   D.   Physicians’ and dentists’ offices and private clinics for human care; professional offices, architects, engineers, and lawyers; barber and beauty shops; offices devoted to real estate, insurance, management, and similar enterprises when not displaying or handling merchandise on the premises. The buildings permitted under this paragraph will be of a design and location compatible with the permitted residential uses.
   E.   Public and private schools for academic instruction, including dormitories.
   F.   Public utility service facilities such as, but not limited to, gas regulator station, telephone exchange, electric substation, water tower or well, sanitary sewer lift stations and treatment facilities, telecommunication facilities.
4.   Height Regulations. No principal building or structure will exceed 40 feet in height and no accessory structure will exceed the elevation of the principal building as verified by a State licensed professional engineer.
5.   Lot Area, Lot Width, and Yard Requirements. Lot area and yard requirements vary depending upon provisions made for neighborhood parks. For a lot to qualify as part of an area with parks, a minimum of 1,000 square feet per lot must be developed as a neighborhood park or parks and this area must be contiguous to or within a reasonable distance, (not greater than one-quarter mile away), of the lots so developed or the equivalent dollar value of 1,000 square feet per lot may be used to fund, improve, or enhance other park areas so designated by the City. The specific provisions of this Section 170.20(5) pertaining to the development of single-family attached dwellings shall supersede other conflicting provisions in this and other ordinances.

6.   Density. The allowable residential density in this zoning district will not exceed 21.78 dwelling units per acre, except under the provisions of a PDD.
7.   Floor Area Ratio. The allowable floor area ratio in this zoning district will not exceed 0.7 or 1.0 for Single-Family Attached dwellings.
8.   Minimum Size of Dwelling. Each single-family detached dwelling will contain at least 1,200 square feet of floor area if one story, or 1,400 square feet of floor area if two stories; each two-family and single-family attached dwelling will contain at least 720 square feet of floor area for each dwelling unit; and each multi-family dwelling will contain at least 600 square feet of floor area for each dwelling unit.
9.   Minimum Spacing Between Buildings. The minimum horizontal distance between any buildings will be 10 feet for single- and two-family dwellings, or combinations thereof, and 30 feet for multi-family dwellings or single-family attached, or combinations thereof, in this zoning district.
10.   Minimum Structure Width. The minimum dimension (width) of the main body of any residential structure will not be less than 22 feet for at least 75 percent of the distance of the major dimension (length).
