1. Time of Construction. No detached, accessory building, structure, or use will be constructed or used on any lot prior to the time of construction of the principal building or use to which it is accessory except when the accessory building, structure, or use is constructed in accordance with the following:
A. Is built on a residential lot that is immediately adjoining that lot upon which is located the principal structure or use and is not separated, in any way, by an alley, street, easement of any sort, or any other public way or any fence or other such structure.
B. The above-referenced adjoining residential lot is owned by the owner of the lot upon which is located the principal use or building only, and the owner(s) execute and record a Restrictive Covenant and Agreement Not to Sever form. For the purpose of administering this section, the adjoining lots shall be considered as one lot with respect to establishing yard and set-back provisions.
C. The proposed building, structure, or use is intended to be used solely for the private and non- commercial benefit of the adjoining property owner.
D. At such time as the lot, upon which is constructed an accessory use or structure, is no longer under the joint ownership of the person owning the lot immediately adjacent to it, then the accessory use or structure will cease to exist and the City may cause said use or structure to be removed by whatever legal means may be available for said remedy at the property owner’s expense.
E. Percentage of Required Yard Occupied. No detached accessory building or buildings will occupy more than 30 percent of the area of a required yard.
F. Height of Accessory Buildings. No detached accessory building or structure will exceed the maximum height as specified for each zoning district.
G. Size and Maximum Number of Accessory Buildings and Structures. The ground floor area aggregate total of any one or more detached accessory buildings or structures on any residential lot, (including RR lots), or immediately adjoining lot(s) as specified in Section 170.40, will not exceed the total ground floor area of the related principal building or structure in question nor more than seven percent of the total lot area(s), whichever is larger. Any detached accessory building greater than 120 square feet shall be stick-built with a permanent foundation, or must be designed, manufactured, and originally intended to be used as an accessory structure and have a permanent foundation. There shall not be more than two detached accessory buildings associated with any one principal building at any time.
H. Location on Lot. No detached accessory building or structure located in a residential district will be erected in any front yard and will be so located as to conform with all other applicable set-back requirements. In any residential district, no detached accessory building or structure shall be closer than eight feet to the principal building, and for each foot over 20 feet in length that the wall of an accessory structure, (except swimming pools), parallels and is next to the principal building, the required distance between the structures shall be increased by an additional one foot.
