170.24 HIGHWAY-ORIENTED

COMMERCIAL SERVICE DISTRICT C-3.

1.   General Description. This commercial district has been designated to provide area for all types of retailing and service uses; certain wholesale and warehousing uses; some limited industrial activities that are normally associated with commercial uses and are non-objectionable in nature; automotive service-type uses and automobile associated uses to serve the transient interstate-highway traffic and tourist-related trades, such as drive-ins, etc.; larger office buildings, complexes, and office parks; international headquarters locations, research and high-tech complexes; large public gathering activities and uses with high traffic volumes; and open space recreational activities; to name just a few of the many potential uses for these areas. This district is normally located along the interstate-highway and major arterial and collector streets, capable of handling large volumes of traffic. The parcels of land should be adequately sized and properly located to allow for larger setbacks, clear vision, safe ingress and egress, larger parking areas needed to service the intended uses, and to promote a quality and park-like atmosphere whereby the natural aesthetic value of these areas are utilized and enhanced by appropriate development. The use of a Planned Development District concept is desirable and preferable in these areas to insure the desired results.
2.   Principal Uses Permitted. Property and buildings in the Highway-Oriented Commercial Service District (C-3) will be used only for the following purposes:
   A.   Any commercial or business use only, (no residential uses), as permitted in the Central Business District.
   B.   Amusement parks and establishments, including: amusement rides, games, arcades, miniature golf course, practice golf range, pool halls, dance halls, swimming pools, skating rinks, archery ranges, shooting galleries, and similar amusement facilities.
   C.   Auction rooms.
   D.   Adult use establishment.
   E.   Automobile diagnostic center.
   F.   Automobile driving instruction station.
   G.   Automobile laundries. (Car Wash).
   H.   Automobile rental.
   I.   Automobile repair shop.
   J.   Automobile sales and rentals.
   K.   Automobile undercoating service.
   L.   Boat sales.
   M.   Bottled gas dealer.
   N.   Bottling works.
   O.   Building services and supplies, including processed building materials.
   P.   Cartage, express and parcel delivery establishment.
   Q.   Commercial greenhouses and nurseries.
   R.   Commercial kennels.
   S.   Commercial marinas, docks, and related services.
   T.   Commercial swimming pool.
   U.   Contractor’s office or completely enclosed workshop/garage, with no exterior storage of equipment or materials.
   V.   Disinfecting and exterminating service.
   W.   Drive-in restaurant.
   X.   Equipment rental and leasing service.
   Y.   Exhibition centers containing exhibition halls and meeting and outdoor display areas, (retail sales space, restaurants with lounge, recreational activities, etc.)
   Z.   Fairgrounds, including cattle and livestock exposition.
   AA.   Farm implement sales.
   BB.   Frozen food locker.
   CC.   Fuels and fuel oil dealer.
   DD.   Furniture repair, reupholster, and cleaning.
   EE.   Garages for storage, repair, and servicing of motor vehicles, including body repair, painting, and engine rebuilding, where no outside storage or work occurs.
   FF.   Garden supply store.
   GG.   Go-cart raceway and amusement rides.
   HH.   Golf course and country club.
   II.   Hotels.
   JJ.   Ice dealer and storage and distribution.
   KK.   Industrial launderer.
   LL.   International headquarters.
   MM.   Lawn mower repair shop.
   NN.   Locksmith shop.
   OO.   Machinery sales.
   PP.   Monument sales.
   QQ.   Motels.
   RR.   Camper and mobile home sales.
   SS.   Motorcycle service and repair.
   TT.   Packing and crating establishment.
   UU.   Paint contractor.
   VV.   Park, private.
   WW.   Planned commercial development, including such facilities as shopping centers, malls, plazas, hotel/motel/restaurant complexes, office parks, etc., only under the provisions of the PDD process.
   XX.   Produce market.
   YY.   Public utility service facilities.
   ZZ.   Recreational gaming facilities.
   AAA.   Repair service – machinery and equipment.
   BBB.   Restaurants.
   CCC.   Retail feed and seed sales, but not bulk storage.
   DDD.   Riding stable.
   EEE.   Septic tank cleaning service.
   FFF.   Sewer cleaning and rodding service.
   GGG.   Sign contractor.
   HHH.   Signs and billboards.
   III.   Swimming pool sales and service.
   JJJ.   Tennis club.
   KKK.   Tire re-treading and repair shop.
   LLL.   Towing service.
   MMM.   Trampoline center.
   NNN.   Water softener service.
   OOO.   Welding shop.
   PPP.   Window cleaning firm.
   QQQ.   Wholesale and warehouse uses such as, but not limited to: direct selling establishment, where products are stored and distributed; other wholesale and warehouse establishments; wholesale bakery; wholesale nursery; wholesale meat cutting and processing, but not including meatpacking.
   RRR.   Industrial type uses such as, but not limited to, assembly firm, without fabrication, of completely fabricated parts; dairy products manufacturer; printing, publishing, and lithography establishment.
   SSS.   Accessory uses, buildings, or other structures and devices customarily incidental to and commonly associated with a permitted use, provided they are operated and maintained under the same ownership, on the same parcel, and do not include structures or features inconsistent with the permitted use.
3.   Special Exceptions. The following principal uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained herein:
   A.   Campgrounds.
   B.   Contractor’s storage yard.
   C.   Model home and garage displays.
   D.   Theater, drive-in.
   E.   Stadium and auditorium.
   F.   Truck service station or truck terminal.
   G.   Outdoor storage facilities, not including junk yards.
   H.   Warehousing uses.
   I.   Any other use determined by the Board of Adjustment upon review to be of the same general character as the foregoing permitted uses.
4.   Height Regulations. No principal building or structure will exceed 100 feet in height and no accessory structure will exceed 40 feet in height or the elevation of the principal building as verified by a State licensed professional engineer, whichever is less.
5.   Lot Area, Lot Width, and Yard Requirements.
   A.   Lot Area. None required. The minimum lot width, setbacks, on-site parking requirements, floor area ratio, building codes, maximum lot coverages, etc., will ultimately determine minimum lot areas.
   B.   Lot Width and Yard Requirements. The following minimum lot and yard width requirements will apply:
      (1)   Lot Width:   150 feet.
      (2)   Front Yard Depth:   50 feet.
      (3)   Side Yard Width:   None, except where adjoining a residential district, then the same or the least width required in that residential district.
      (4)   Rear Yard Depth:   10 feet, except where adjoining a residential district, then the same as required in that district.
6.   Special Provisions.
   A.   Enclosure of Operations. All business, servicing, (including solid waste collection and storage), or processing will be conducted within completely enclosed buildings or structures, except:
      (1)   Off-street parking or loading.
      (2)   Accessory uses when allowed by a special exception.
   B.   Screening. Where a commercial use abuts or is across the street from a residentially-zoned district, adequate screening will be provided in accord with Section 170.43.
   C.   Parking Provisions. Parking spaces and areas will be provided, in accordance with the applicable regulations set forth in Section 170.52.
   D.   Performance Standards. All activities will conform with the performance standards established for the Light Industrial District (I-1).
   E.   Sign Requirements. Any sign erected will be done so in accordance with the applicable regulations set forth in Section 170.53.
   F.   Outdoor Sales. All outdoor sales space will be provided with a permanent durable and dustless surface, and will be graded and drained so as to properly dispose of all surface water.
   G.   Outdoor Storage. Generally, outdoor storage will not be permitted, and when permitted upon review by the Planning and Zoning Commission and the Council, all outdoor storage facilities for fuel, raw materials, products, and all objectionable materials will be enclosed by a fence, wall, or plant materials adequate to completely conceal such facilities from any adjacent properties and any public right-of-way.
   H.   Waste Materials. No materials or wastes will be deposited upon a lot in such a form that may be transferred off the property by natural causes or forces.
7.   Floor Area Ratio. The allowable floor area ratio in this zoning district will not exceed 0.5.
8.   Maximum Lot Coverage. Not more than 60 percent of the lot area may be occupied by buildings and structures, including accessory buildings.
